公司法的自由主义及其法律依据探讨

【摘要】：在社会主义市场经济背景下,公司的自由是公司发展的必然需求,是保持市场活力的必备条件,是提高和发展生产力的必备环境,是公司和企业的"第二生命"。我国也出台了相应的公司法律赋予了公司极大地自由权利,但是也相应的限制了公司的自由发展。
[Abstract]:Under the background of socialist market economy, the freedom of the company is the inevitable demand for the development of the company, the necessary condition for maintaining the market vitality, the necessary environment for improving and developing the productive forces, and the "second life" for the company and the enterprise. Our country also issued the corresponding company law to endow the company with the great freedom right, but also restricted the company's free development correspondingly.
