论完善资本市场层次结构与相关法律体系建设

【摘要】：资本市场层次结构完善与否,由市场经济发育程度及相关法律体系建设情况所决定。完善我国资本市场层次结构,满足不同规模、不同发展阶段和不同风险程度的经济主体的资金融通、产权交易需求,应围绕以沪深交易所为核心的主板市场和创业板市场主干体系,积极建设和完善我国资本市场的法律体系,形成以《证券法》、《公司法》、《证券投资基金法》、《刑法》等为主轴,配套可操作的创业板法律、政策规章,构建完备而富有层次的资本市场法律保障体系,从而防范市场风险,保护投资者利益。
[Abstract]:Whether the hierarchy of capital market is perfect or not is determined by the development of market economy and the construction of relevant legal system. To improve the hierarchical structure of China's capital market, to meet the needs of financing and property rights transactions of economic agents of different scales, stages of development and different degrees of risk, It is necessary to build and perfect the legal system of China's capital market around the mainboard market and the gem market trunk system with the Shanghai and Shenzhen Stock Exchange as the core, and take the Securities Law, the Company Law, the Securities Investment Fund Law, the Criminal Law and so on as the main axis. In order to guard against market risks and protect investors' interests, a complete and multilevel legal guarantee system of capital market should be constructed by supporting the operational laws and regulations of gem.
