新公司法对银行信贷风险管理的影响及其对策

【摘要】：2006年1月1日起正式施行的新《公司法》,是对93年《公司法》的全面修订,也是历年来规模最大的一次修订。新《公司法》不论是在立法理念上,还是在一些具体规则的制定上,都较过去做出了很大的变动。商业银行作为公司的主要债权人,其利益不可避免地会受到影响,并需要做出相应的调整。本文拟就新公司法对银行信贷业务风险管理的影响,及银行对策做一番讨论。
[Abstract]:The new Company Law, which was formally implemented on January 1, 2006, is a comprehensive revision of the Company Law of 1993 and the largest revision in the past years. The new Company Law has made great changes both in the legislative concept and in the formulation of some specific rules. As the main creditor of the company, commercial banks have their benefits. Benefits will inevitably be affected and need to be adjusted accordingly. This paper intends to discuss the impact of the new company law on risk management of bank credit business and bank countermeasures.
