【摘要】：经济补偿金制度的设立往往与劳动合同解除或者终止之后劳动者的利益紧密相关。《劳动合同法》的问世,相较于以往的劳动法规在经济补偿金计算的法律适用方面存在较大的界别和差异。为此,本文首先从经济补偿金性质的理论分析着手,对经济补偿金计算的适用范围、计算基数与工作年限等三个维度的法律适用进行深入研究与分析,对与经济补偿金相关的赔偿金制度一并做了解读与释义,并针对经济补偿金计算中存在的法律适用未竞事宜进行了相应探讨。
[Abstract]:The establishment of the system of economic compensation is often closely related to the interests of workers after the termination or termination of the labor contract. Compared with the previous labor laws and regulations in the calculation of economic compensation in the legal application of greater sectors and differences. Therefore, this paper first from the nature of economic compensation theory analysis. The scope of application of the calculation of economic compensation, calculation base and working years of the three dimensions of the legal application of in-depth research and analysis, and economic compensation related to the compensation system as well as interpretation and interpretation. It also discusses the legal application in the calculation of economic compensation.

【正文快照】： 纵观世界劳动法典化的国家,关于经济补偿金往往存在着不同的名称与称谓。典型的如法国的《劳动法典》中其法律名称为“辞退补偿金”或者是“解雇补偿金”;德国的《解雇保护法》将其命名为“一次性补偿金”;我国台湾地区的《劳动基准法》将其命名为“资遣费”,等等,不一而足。
