经济法如何保障交易公平——从功能视角研究市场规制法

【摘要】：合同法是规范交易的基本法 ,但不足以保障交易机会配置和交易过程及结果的公平。经济法中的市场规制法通过抑强扶弱等手段保障交易公平 ,从而促进交易。从交易促进的视角研究市场规制法 ,可以较好地构建市场规制法的内部结构 ,从而使市场规制法成为一个逻辑严密的经济法子系统。
[Abstract]:Contract law is the basic law to regulate the transaction, but it is not enough to guarantee the distribution of the trading opportunity and the fairness of the transaction process and result. The market regulation law in the economic law guarantees the transaction fairness by means of restraining the strong and strengthening the weak, etc. From the perspective of transaction promotion, we can construct the internal structure of the market regulation law and make the market regulation law a logical subsystem of economic law.
