论我国非全日制用工法律制度的完善

【摘要】:伴随着我国产业结构调整和市场经济的发展,非全日制用工作为一种重要的推广灵活就业的用工形式得到了迅猛发展,已经成为缓解就业压力和劳动力供求矛盾加剧的重要途径。另一方面,非全日制用工作为一种新兴的、非主流的用工方式,仍隐含着诸多不利于劳动者权益保护的因素。当前我国经济发展中对非全日制用工的实践和理论探索仍处于起步阶段,虽有2008年的《劳动合同法》和2010年实施的《社会保险法》对这一新兴的用工方式进行的相应规定,仍解决不了规定过于原则化,操作难的问题。所有这些现状都亟待非全日制用工制度的进一步完善。全文包括引言、正文和结语三部分,正文可分为四个部分:第一部分,笔者主要从非全日制用工的基本理论进行阐述。首先,明确界定本文所讨论的非全日制用工主要是指我国劳动合同法规定的以小时计酬为主要标准的用工形式,以现阶段国内学者对非全日制用工的研究为基础,从理论基础、法律制度现状和法律制度完善对策三方面对其进行分析,界定其含义;其次,将非全日制用工与全日制用工、非正规就业以及兼职等相关概念进行横向比较,着重分析非全日制用工的优势;最后,阐述其在降低用工成本和缓解就业压力方面的社会意义。第二方面,笔者主要阐述了我国立法中对非全日制用工的具体规定,然后根据社会经济实践中出现的系列问题,对我国的非全日制用工制度的实施情况和社会效果进行分析,指出其现阶段存在的不足。第三部分,笔者主要介绍了当今世界各国对非全日制用工制度比较有代表性的规定,比如荷兰、德国、美国和日本等发达国家的经验,分析并借鉴上述国家对非全日制用工的先进规定,旨在从中吸取优秀的立法经验,弥补我国对非全日制用工制度规定的不足,不断完善我国的非全日制用工法律制度建设。第四部分,针对我国非全日制用工制度存在的不足,笔者主要从现行立法的修改和完善方面入手,具体在明确适用范围、书面劳动合同形式、最低工资和最高工时保障以及社会保险方面提出建设性构想,实现完善我国非全日制用工法律制度的目的,期使其更好的发挥促进经济发展的作用。
[Abstract]:With the adjustment of industrial structure and the development of market economy, part-time employment, as an important form of promoting flexible employment, has developed rapidly. It has become an important way to relieve the employment pressure and intensify the contradiction between supply and demand of labor. On the other hand, part-time employment is a new and non-mainstream way of employment. There are still many factors that are not conducive to the protection of workers' rights and interests. At present, the practice and theoretical exploration of part-time employment in China's economic development is still in its infancy. Despite the corresponding provisions of the Labor contract Law of 2008 and the Social Insurance Law implemented in 2010 on this emerging mode of employment, it is still not possible to solve the problem that the regulations are too principled. All these present situations urgently need to be further perfected in the part-time employment system. The full text includes three parts: introduction, text and conclusion. The text can be divided into four parts: the first part, The author mainly expounds the basic theory of part-time employment. First of all, the author clearly defines the part-time employment discussed in this paper mainly refers to the employment form of hourly pay as the main standard of labor contract law of our country. Based on the study of part-time employment by domestic scholars at present, this paper analyzes and defines the meaning of part-time employment from three aspects: theoretical basis, current situation of legal system and legal system perfection. The relative concepts of informal employment and part-time employment are compared horizontally, and the advantages of part-time employment are emphatically analyzed. Finally, the social significance of informal employment and part-time employment in reducing employment costs and alleviating employment pressure is expounded. The author mainly expounds the specific provisions of part-time employment in our country's legislation, and then, according to the series of problems in social and economic practice, analyzes the implementation and social effects of the part-time employment system in China. In the third part, the author mainly introduces the representative regulations of part-time employment system in various countries in the world, such as the experiences of developed countries such as the Netherlands, Germany, the United States and Japan. This paper analyzes and draws lessons from the advanced regulations on part-time employment in the above-mentioned countries in order to absorb excellent legislative experience and make up for the deficiencies of China's part-time employment system. The fourth part, in view of the deficiency of the part-time employment system in our country, the author mainly starts with the revision and perfection of the current legislation, and makes clear the scope of application. The form of written labor contract, the guarantee of minimum wage and maximum working hours and the social insurance put forward constructive ideas to realize the purpose of perfecting the legal system of part-time employment in our country, so that it can play a better role in promoting economic development.
