国内航空托运行李运输承运人责任制度的研究

【摘要】:近年来,国内航空托运行李运输的问题日益引起消费者和媒体的关注,解决航空托运行李运输的纠纷关键在于明确航空承运人的责任制度。本文主要围绕国内航空托运行李运输的相关问题进行探讨和研究,以承运人责任制度为主线,采用了文本研究与对比研究、实证研究与制度研究、系统分析与价值评价等方法,通过对《合同法》、《侵权法》等基本法和《民用航空法》、《中国民用航空旅客、行李国内运输规则》等特别法进行梳理,分析国内航空托运行李运输承运人责任制度存在的问题并提出完善的建议,,旨在为消费者维权提供依据,提高承运人依法处理托运行李纠纷的可操作性。 本文除前言和结论外,正文分为三章进行理论研究和实践探索: 第一章分析国内航空托运行李运输的承运人责任体系的具体构成,包括法律体系、责任原则、责任构成和赔偿四部分。第一部分针对国内航空法中与托运行李运输承运人责任有关的规定进行梳理,并且明确国内航空运输中对相关概念的法律界定。第二部分进一步介绍了托运行李运输的承运人责任期间、托运行李毁损和延误两种不同情形下的责任原则以及免责事由;第三部分着重分析托运行李运输的承运人责任的性质以及承运人责任构成的立法现状;第四部分明晰了托运行李毁损和托运行李延误的赔偿标准,我国目前对于托运行李运输的责任限额和突破责任限额例外的规定,并指出其存在的弊端。 第二章主要指明了国内航空运输中托运行李承运人责任体系现存的问题,并且借鉴国外先进的托运行李纠纷处理经验。第一部分是在总结前文的基础上对我国立法政策方面存在不足进行的一个系统化梳理;第二部分则主要针对国际公约和航空业发达国家的国内法中涉及托运行李运输承运人责任制度的先进经验进行借鉴,航空业发达国家以美国、欧盟和日本为典型代表。 第三章着重对完善我国国内航空托运行李运输的承运人责任进行思考。针对现存的问题,在借鉴适合中国航空业发展阶段的经验的基础上,综合考虑制定出我国国内航空托运行李运输承运人责任体系的立法改进建议。在法律、行政法规、部门规章等层面完善中国民用航空法的托运行李承运人责任制度,从明晰托运行李的法律界定、明确承运人责任的性质、填补托运行李延误承运人责任的空白和保障旅客知情权等方面着手,构建更加完善的国内航空托运行李承运人责任制度。
[Abstract]:In recent years, the problem of domestic air checked baggage transportation has attracted more and more attention from consumers and media. The key to resolve the dispute of air consignment baggage transportation is to clarify the liability system of air carrier. This paper mainly discusses and studies the related problems of domestic air consignment baggage transportation, takes the carrier liability system as the main line, adopts the text research and the contrast research, the demonstration research and the system research, the system analysis and the value appraisal and so on. Through combing the basic Law, the Tort Law, and the Civil Aviation Law and other special laws such as the contract Law, the Law on Civil Aviation of China, the rules for domestic Transport of Chinese Civil Aviation passengers and luggage, and other special laws, This paper analyzes the problems existing in the carrier's liability system of domestic air consignment baggage transportation and puts forward some perfect suggestions in order to provide the basis for the consumers' rights of rights and to improve the maneuverability of the carrier to deal with the disputes of checked baggage according to law. In addition to the preface and conclusion, the text is divided into three chapters for theoretical research and practical exploration: The first chapter analyzes the specific constitution of carrier's liability system of domestic air consignment baggage transportation, including legal system, liability principle, liability constitution and compensation. The first part combs the provisions of domestic air law related to the carrier's responsibility and defines the relevant concepts in domestic air transport. The second part further introduces the liability principle and the reason of exemption in two different cases of baggage damage and delay during the period of carrier's responsibility for the carriage of checked baggage. The third part focuses on the analysis of the nature of the carrier's liability and the legislative status of the carrier's liability. The fourth part clarifies the standard of compensation for damage to checked baggage and delay of checked baggage. At present, the limitation of liability and the exception of breaking the limit of liability for checked baggage transportation are stipulated in our country, and the disadvantages are pointed out. The second chapter mainly points out the existing problems of the carrier's liability system in domestic air transportation, and draws lessons from the foreign advanced experience in handling the dispute over checked baggage. The first part is a systematic combing of the shortcomings of our country's legislative policy on the basis of summarizing the above. The second part mainly focuses on the international conventions and the domestic laws of the developed countries in the aviation industry involving the advanced experience of the carrier liability system of baggage transportation. The developed countries of aviation industry take the United States, the European Union and Japan as the typical representatives. The third chapter focuses on the improvement of domestic air baggage carrier responsibility. In view of the existing problems and on the basis of drawing lessons from the experience suitable for the development stage of China's aviation industry, this paper synthetically considers the legislative improvement suggestions for the formulation of the carrier's liability system of air consignment baggage transportation in China. In the aspects of law, administrative regulations, department regulations and so on, we should perfect the carrier's liability system of checked baggage in China's civil aviation law, define clearly the legal definition of checked baggage, and clarify the nature of the carrier's liability. In order to fill the gap of carrier's responsibility and protect passengers' right to know, a more perfect liability system of domestic air baggage carrier should be established.
