“深圳宝安政府采购程序瑕疵导致废标”案分析——兼论政府采购的契约属性与程序正义

【摘要】："深圳宝安政府采购程序瑕疵导致废标"案是有关政府采购的典型案例。在将本案所涉的提供公共货物的政府采购定性为行政合同的基础上,依据《政府采购法》、《招标投标法》、《合同法》和相关法律原则,可以分别对四个争议点做出如下判断:政府采购中心违法修改招标文件造成了程序瑕疵;该程序瑕疵导致招标无效,原告应被废标;若政府采购中心已与原告签订采购合同,该合同亦无效;政府采购中心须向原告和第三人承担法律责任。同时,本案还带来了一些启示,包括正确理解财税法定主义,关注财政支出的程序正义,及厘清《政府采购法》与《招标投标法》、《合同法》间的关系。
