日本铁路建设法律制度及启示

【摘要】：日本铁路立法是不同历史时期政府铁路产业政策的法律化,表现形式分为铁路法律和铁路省令。日本铁路改革促成日本现行铁路法律体系的形成,其突出特点是为铁路改革进行专门立法。日本铁路法律体系主要包括铁路改革法、企业法、行业管理法、运输合同法、铁路建设法和劳动法等方面的内容。日本铁路建设法律制度重点包括日本铁路建设企业法律制度和铁路建设管理制度的相关内容。对我国铁路建设投融资制度和铁路建设管理体制的建设具有有益的启示。
[Abstract]:Japanese railway legislation is the legalization of the government's railway industry policy in different historical periods. The reform of the Japanese railway promotes the formation of the current railway legal system in Japan, and its outstanding feature is to legislate specifically for the reform of the railway. The Japanese railway legal system mainly includes the railway reform law, the enterprise law, the industry management law, the transportation contract law, the railway construction law and the labor law and so on. The legal system of Japanese railway construction mainly includes the legal system of Japanese railway construction enterprise and the management system of railway construction. It has beneficial enlightenment to the investment and financing system of railway construction and the construction of railway construction management system.
