【摘要】：摘要：《中华人民共和国循环经济促进法》的颁布实施,对于规范循环经济在我国的发展极为重要。20世纪90年代末循环经济思想引入我国,在此之前关于循环经济理论的研究也相当丰富,但是一直缺乏法律上的支持,《循环经济促进法》的出台解决了这一问题。一部法律的问世必然涉及到法律的施行,实施法律首要任务在于法律的宣传普及。当然法律普及不能一概而论,应当有的放矢。找出《循环经济促进法》普及中最为薄弱的地区进行强化是取得有效工作成果的一种科学方式。西部农村发展循环经济的状况不论是与东中部的城市、农村相比,还是与西部的城市比较,都是最为落后的,这决定了该地区法律宣传与普及方式落后,法律所起的作用有限。本文主要采用马克思主义方法论(循环经济与《循环经济促进法》的双向关系)、实证调研等研究方法在论文写作前与写作中于2012年12月、2013年3月、2013年8月对本法在广西省柳州市融安县、河池市,陕西省,甘肃省等西部省份的农村地区普及的状况进行调研,找出本法在西部农村普及的障碍与原因,进而提出意见与建议,以期促进《循环经济促进法》在西部农村的普及,使循环经济发展的理念深入人心,从而为西部农村循环经济的发展提供法律上的保障,促进西部农村循环经济大力向前发展。本篇论文的写作有两个目的。目的之一是厘清循环经济与《循环经济促进法》之间的双向关系,从发展循环经济的角度促进《循环经济促进法》的宣传与普及。其理论依据在于：根据马克思历史唯物主义观点,循环经济属于经济基础的一部分,而《循环经济促进法》是一部制定法,属于上层建筑的组成部分。前者决定后者,后者能动反作用于前者。因此从理论上来讲循环经济的深入发展促使了《循环经济促进法》的出台,而《循环经济促进法》的普及必定会对循环经济的进一步发展具有积极的促进作用。目的之二是从法律宣传与普及对提升公民法律意识的作用角度,通过对西部农村居民的循环经济法律意识的调研状况的分析,反推法制宣传、法律普及中存在的问题,找出对应的原因,创新法律宣传与普及的手段与方式,切实加强西部农村《循环经济促进法》的普及,从而促进该地区循环经济的发展。本篇论文主要内容如下：全篇论文总共四个部分,从理论与实证方面展开分析与论述。第一部分采取层层递进的方式概述西部农村《循环经济促进法》普及问题。包括三个层次,第一是法律普及概述；第二是《循环经济促进法》普及概述；第三是西部农村《循环经济促进法》普及概述。通过共性到个性的递进式分析普法问题,突出《循环经济促进法》普及的特点和西部农村普法的个性。第二部分论述《循环经济促进法》在西部农村普及状况及原因分析。普及的状况主要通过分析在陕西、甘肃、广西等省份的调研数据与访谈纪要得出。同时笔者在这一部分总结了西部农村《循环经济促进法》普及的具体形式、取得的成绩以及存在的问题。同时针对存在的问题进行了原因的分析,包括五点原因。循环经济在西部农村地区发展缓慢,城乡二元社会结构制的原因,立法模式上的原因,法律本身的原因这四点原因是间接的、内在的、本质的原因；普法形式的原因是直接的、表面的、形式的原因。第三部分的论述加强了论文的理论性。分析了《循环经济促进法》在西部农村普及的必要性与可行性。必要性的分析主要从经济因素、社会因素、生态环境因素三个方面进行论述。第四部分针对存在的问题和原因分析,提出了相应的建议。主要是四个方面,即加速发展西部农村循环经济；改革城乡管理体制与分配制度；改进立法模式；创新普法方式。
[Abstract]:Abstract: the promulgation and implementation of the law on the promotion of circular economy in People's Republic of China is very important for the standardization of the development of circular economy in our country. In the late 1990s, the concept of circular economy was introduced into China. Before that, the research on circular economy theory is quite abundant, but there has been lack of legal support. The introduction of circular economy promotion law has solved this problem. The advent of a law inevitably involves the implementation of the law, and the primary task of the implementation of the law lies in the publicity and popularization of the law. Of course, the universal law can not be generalized and should be targeted. It is a scientific way to find out the results of effective work by finding out the weakest areas in the popularization of the circular economy promotion law. The development of circular economy in the western rural areas is the most backward compared with the eastern and central cities and the rural areas. Compared with the western cities, it is the most backward one, which determines the backward area of law propaganda and popularization, and the role of the law is limited. This paper mainly uses the Marx doctrine methodology (circular economy two-way relationship with the "Circular Economy Promotion Law"), empirical research and other research methods before writing and writing in December 2012, March 2013 and August 2013 of this Law in Guangxi Province, Liuzhou city county, Hechi City, Shaanxi Province, the popularity of the western provinces of Gansu province for research the situation in rural areas, to find out the law in the western rural areas popular obstacles and reasons, and then put forward opinions and suggestions, in order to promote the popularization of "Circular Economy Promotion Law" in the western rural areas, the development of circular economy concept deeply rooted, so as to provide legal protection for the development of western rural circular economy, promote western the rapid development of circular economy.
