我国民用核设施的法律规制

【摘要】：核能作为一种供给稳定、清洁、经济的能源，在近年来传统能源逐渐枯竭和环境不断恶化的情况下，越来越凸显其重要性，在解决人类能源危机的可行性方案中占十分重要的地位。但是，核设施安全事故带来的巨大损失和伤害又让人对核能的发展心怀疑虑。1986年切尔诺贝利事件余烟未消，2011年福岛核事故又再一次我们敲响警钟。因此，，核设施的安全工作在核能发展中至关重要，构建完善的民用核设施法律规制体系应具有一定的意义。本文以民用核设施为切入点，通过对我国立法现状的阐述以及对其他国家和地区的立法分析，针对我国民用核设施法律规制之不足，试图构建比较完善的民用核设施法律规制体系，为我国核能安全发展和利用提供一点建议。本文共分为四部分。第一部分主要对文章论述内容的范围进行界定，并且简要探讨民用核设施相对于军用核设施所具备的特点。第二部分主要介绍我国民用核设施的立法现状以及存在的问题。这一部分主要论述我国目前与民用核设施相关的立法，通过详细列举和划分层次，整理出我国民用核设施法律规制的脉络，同时从宏观角度检视我国目前民用核设施立法体系存在的问题。第三部分从微观角度分析我国目前民用核设施法律规制的不足，将民用核设施的环保进程划分为事前预防、事中控制和事后救济三个阶段，分别论述各个阶段存在的问题。最后一部分主要针对上文所提出的不足来论述我国民用核设施法律规制体系的改进方案，其中包括对立法架构、各阶段具体规定以及相关配套制度等问题的具体阐述。
[Abstract]:Nuclear power as a stable supply, clean and economical energy, the gradual depletion of traditional energy and environmental deterioration of the situation in recent years, more and more highlights its importance, occupies very important position in the feasible scheme to solve the energy crisis. However, great damage and harm of nuclear facilities safety accidents and people.1986 doubts about nuclear power in Chernobyl incident smoke disappeared, the 2011 Fukushima nuclear accident once again sounded the alarm. Therefore, safety of nuclear facilities is crucial in the development of nuclear energy, and establish the complete legal regulation system of civil nuclear facilities should have a certain significance. In this paper, the civil nuclear facilities as the starting point based on the status quo of China's legislation on the elaboration and analysis of legislation in other countries and regions, for the lack of legal regulation of civil nuclear facilities in China, trying to build more perfect The legal regulation system of civil nuclear facilities provides some suggestions for the development and utilization of nuclear energy security in China.
This paper is divided into four parts. The first part mainly defines the scope of content, and briefly discuss the civil nuclear facilities with respect to the characteristics of military nuclear facilities. The second part mainly introduces the status quo of legislation of civil nuclear facilities in China and the existing problems. This part mainly discusses China's current related civil nuclear the facilities of legislation, through detailed enumeration and classification level, sorting out the legal regulation of civil nuclear facilities in our context, at the same time to examine our existing civil nuclear facilities of the legislative system problems from a macro perspective. In the third part, from the micro perspective analysis of China's current civil nuclear facilities lack of legal regulation, the civil nuclear facilities of environmental protection the process is divided into prevention, control and relief after three stages, each stage of the problems were discussed. In the last part, aiming at the above mentioned is not This article discusses the improvement plan of the legal regulation system of China's civil nuclear facilities, including the legislative framework, the specific provisions of each stage and the related supporting system.
