三峡库区生态环境法律保护研究

【摘要】： 区域可持续发展是国家可持续发展战略的重要组成部分,三峡库区因为三峡工程的修建,该区域内的社会经济发展、资源开发、环境保护问题一直倍受世人关注,“法治”作为推动区域经济、政治、文化、社会四元可持续发展的新战略,将成为区域生态化建设不可或缺的保障1。正因如此,本文分五个部分对三峡库区生态环境法律保护问题进行了认真梳理,其具体内容如下: 第一部分为三峡库区生态环境概述。在这一部分中,首先介绍了三峡库区的地理位置、自然条件及资源分布状况。其次,对三峡库区生态环境现状进行了分析。同时,由于三峡库区是三峡工程所在地,兴修三峡工程不可避免的对三峡库区的生态环境状况产生了各种积极和消极的影响,本文也进行了一一列举,希望能引起各方面的重视,并最终能对三峡库区生态环境法律保护工作的建设有所帮助第二部分为三峡库区生态环境法律保护的基础理论,这一部分首先从生态文明建设、可持续发展、规范三峡库区管理三个角度分析了三峡库区生态环境保护立法的必要性。其次,论述了三峡库区生态环境保护立法的指导思想,提出以环境伦理观,科学发展观为指导进行法治建设。最后,针对三峡库区的具体情况,结合环境法学基础理论,有针对性的提出了“生态安全”、“协调发展”、“风险预防”、“协同合作”四项基本原则。第三部分探析了三峡库区生态环境保护的专项法律制度构建,首先指出各项环境法律基本制度在三峡库区生态环境法律保护建设中,有各自的作用和重要性。其次,顺应国内理论研究趋势,重点探析了三峡库区生态补偿法律制度的构建,又因为三峡库区水资源极其丰富、矿产资源较多,是三峡库区基础性的自然资源,如何对两者进行丌发、利用、保护,很大程度上决定着该地区的资源状况,所以本文又深入探讨了流域水态补偿机制和矿产资源开发补偿机制的构建。第四部分为三峡库区生态环境法律保护目前面临的问题分析,这部分内容主要是从环境立法、环境行政管理、环境执法、环境监管与应急体系、公民环境意识等几个方面阐述了三峡库区生态环境法律保护存在的问题。第五部分为完善三峡库区生态环境法律保护的建议,这一部分的内容主要是针对三峡库区生态环境法治前述存在的问题,结合国内环境法学相关的研究成果,提出了若干完善建议,以期能为三峡库区生态环境保护作出微薄贡献。
[Abstract]:Regional sustainable development is an important part of the national sustainable development strategy. Because of the construction of the three Gorges Project, the social and economic development and the exploitation of resources in the three Gorges Reservoir area, As a new strategy to promote regional economic, political, cultural and social sustainable development, the "rule of law" will become an indispensable guarantee for regional ecological construction. This article divides five parts to the three Gorges reservoir area ecological environment legal protection question to carry on the careful combing, its concrete content is as follows:. The first part is an overview of the ecological environment of the three Gorges Reservoir area. In this part, the geographical location, natural conditions and distribution of resources in the three Gorges Reservoir area are first introduced. Secondly, the present situation of the ecological environment in the three Gorges Reservoir area is analyzed. Since the three Gorges Reservoir area is the site of the three Gorges Project, the construction of the three Gorges Project will inevitably have a variety of positive and negative effects on the ecological environment of the three Gorges Reservoir area. Finally, it will be helpful to the construction of the legal protection of ecological environment in the three Gorges Reservoir area. The second part is the basic theory of the legal protection of the ecological environment in the three Gorges Reservoir area. This part begins with the construction of ecological civilization and the sustainable development. This paper analyzes the necessity of the legislation of ecological environment protection in the three Gorges Reservoir area from three angles of standardizing the management of the three Gorges Reservoir area. Secondly, it discusses the guiding ideology of the legislation on the ecological environment protection of the three Gorges Reservoir area, and puts forward the view of environmental ethics. Finally, according to the concrete situation of the three Gorges Reservoir area and the basic theory of environmental law, four basic principles of "ecological security", "coordinated development", "risk prevention" and "cooperative cooperation" are put forward. The third part analyzes the construction of the special legal system of ecological environment protection in the three Gorges Reservoir area. Firstly, it points out that each basic environmental law system has its own role and importance in the construction of the ecological environment legal protection in the three Gorges Reservoir area. In accordance with the trend of domestic theoretical research, this paper focuses on the construction of the legal system of ecological compensation in the three Gorges Reservoir area. Because the three Gorges Reservoir area is extremely rich in water resources and has more mineral resources, it is the basic natural resource of the three Gorges Reservoir area. How to develop, utilize and protect them determines the resource situation in this area to a great extent, so this paper also discusses the construction of water state compensation mechanism and mineral resources development compensation mechanism. The 4th part is an analysis of the problems facing the legal protection of the ecological environment in the three Gorges Reservoir area. This part mainly includes environmental legislation, environmental administration, environmental law enforcement, environmental supervision and emergency response system. This paper expounds the problems existing in the legal protection of ecological environment in the three Gorges Reservoir area from several aspects such as citizen's environmental consciousness. The 5th part is to improve the legal protection of the ecological environment in the three Gorges Reservoir area. The content of this part is mainly aimed at the aforementioned problems of the rule of law in the ecological environment of the three Gorges Reservoir area, combined with the research results related to the domestic environmental law. Some suggestions are put forward in order to contribute to the protection of ecological environment in the three Gorges Reservoir area.
