论我国煤炭资源物权化中的行政规制

【摘要】： 煤炭资源是我国使用最为广泛的基础能源,煤炭资源的权属安排对于我国经济增长和社会发展具有突出意义。但是随着我国经济的快速发展对煤炭资源需求的愈来愈大,所产生的负面问题也愈加明显,包括资源浪费,安全事故频发,环境破坏严重等,说到底是对煤炭资源不合理的开发利用造成的。 “适应市场经济的发展,依托物权法对自然资源的利用进行调整得到法学界的共识。”1但是与传统物权制度强调物权的私人属性和意思自治的绝对性不同,煤炭资源作为一种自然资源,具有“公共物品”属性,其物权化过程中“参杂”了很多公权力要素。在市场经济背景条件下,不仅需要明确煤炭资源的国有属性,还需要实现所有权基础上的行政权,而这种行政权的具体表现形式之一,就是行政规制。煤炭资源物权制度中的行政规制是以实现煤炭资源开发利用的效用最大化为基本目标,强调自身结构体系的不断完善和市场机制的契合,几乎覆盖了煤炭资源从勘探开采到生产经营的全部过程。但是我国行政规制的相应实施却存在很大缺陷。造成这种局面的原因是多方面的,包括:行政规制权力本身配置的不合理性;物权制度存在瑕疵;相关立法粗糙,缺乏可操作性;传统行政规制模式的桎梏;行政规制监督的不到位等。针对这些问题及原因,要完善我国煤炭资源物权制度中的行政规制,就必须做到:实现行政规制权力的优化配置,确立针对煤炭资源物权制度的属地化规制,实现行政规制模式的转变,严格责任追究,加强规制监督以及实现行政规制方式的多样性等。
[Abstract]:Coal resources are the most widely used basic energy in China. The ownership arrangement of coal resources is of great significance to the economic growth and social development of our country. However, with the rapid development of our economy, the demand for coal resources is increasing. The negative problems are becoming more and more obvious, including waste of resources, frequent accidents, serious environmental damage and so on, which is caused by unreasonable exploitation and utilization of coal resources. "adapting to the development of market economy and adjusting the utilization of natural resources based on the real right law has gained a consensus in the field of law." (1) but different from the traditional real right system, which emphasizes the private attribute of real right and the absolute autonomy of will, Coal resources, as a kind of natural resources, have the attribute of "public goods", and many elements of public power are involved in the process of real right transformation. Under the background of market economy, not only the state-owned attributes of coal resources should be clearly defined. We also need to realize the administrative power based on ownership, and one of the concrete forms of this administrative power is administrative regulation. The administrative regulation in the real right system of coal resources is aimed at maximizing the utility of the exploitation and utilization of coal resources, emphasizing the continuous perfection of its own structure system and the conformity of the market mechanism. It almost covers the whole process of coal resources from exploration and exploitation to production and management. However, the corresponding implementation of administrative regulations in our country has great defects. The reasons for this situation are various. Including: the irrationality of the allocation of the administrative regulation power itself; the defects of the real right system; the rough legislation and lack of operability; the shackles of the traditional administrative regulation mode; the imperfection of the administrative regulation supervision. In order to perfect the administrative regulation in the real right system of coal resources in our country, we must realize the optimal allocation of the administrative regulation power, establish the localization regulation for the real right system of coal resources, and realize the transformation of the administrative regulation mode. Strict liability investigation, strengthening regulation supervision and realizing the diversity of administrative regulation methods.
