低碳经济背景下我国能源法律制度研究

【摘要】：能源是社会物质生活的基础,经济发展的命脉,对能源的开发利用为人类创造了大量的物质财富。然而,由于能源具有稀缺性,人类肆无忌惮的滥开、滥采、滥用造成了能源的急剧减少,生态的巨大破坏,引发了诸多环境问题。当前,为了应对温室气体过量排放引起的气候变化和能源过度消耗导致的能源危机,全球掀起了发展“低碳经济”的浪潮。我国也明确提出发展低碳经济,以应对日益加剧的能源环境问题。优化能源结构,构建稳定、经济、安全、清洁的能源供应体系,是促进我国低碳经济发展,实现经济和能源可持续发展的途径之一。为了缓解我国能源危机,促进能源的可持续开发利用,必须以科学发展观为指导,建立完备的能源法律体系和完善的能源法律制度。本文的结构包括引言、主体和结语三个部分,主体部分包括四章。第一章概述了低碳经济和能源法的基本理论。从概念入手,介绍了低碳经济的内涵,低碳经济与能源法律制度的关系,我国能源法律制度的低碳化；随后介绍了低碳化能源法律制度的三个理论基础,即生态伦理与能源法目的之转变、外部性理论和环境权理论,这些理论为我国能源法律制度的低碳化奠定了理论基础。第二章是对我国能源法律制度现状的分析。介绍了我国能源法现状,分析了我国主要能源法律制度的内容,指出了现有能源法律制度的低碳化之不足。第三章是对国内外能源法律制度的比较研究,首先概述了英国、美国、日本、德国等国家的能源法律概况,其次运用比较研究,实证分析的方法对中外能源法律制度进行分析,总结出国外优秀制度对我国予以借鉴。第四章,提出完善我国低碳化的能源法律制度的设想。借鉴国外先进立法经验结合我国实际情况,对低碳经济背景下如何完善我国能源法律制度,提出一些可能行之有效的建议,填补一些内容上的空白,以期对我国能源法律制度的健全、能源的可持续利用及低碳经济的发展贡献一点微薄之力。
[Abstract]:Energy is the foundation of social material life, and the lifeblood of economic development. The exploitation and utilization of energy have created a great deal of material wealth for mankind. Abuse has caused a sharp decline in energy, huge ecological damage, and caused many environmental problems. At present, in order to deal with the climate change caused by excessive greenhouse gas emissions and the energy crisis caused by excessive energy consumption, The world has set off a wave of developing "low-carbon economy". China has also explicitly proposed to develop low-carbon economy in order to deal with the growing energy environment problems, optimize the energy structure, and build a stable, economic, safe and clean energy supply system. It is one of the ways to promote the development of low-carbon economy and realize the sustainable development of economy and energy. In order to alleviate the energy crisis and promote the sustainable development and utilization of energy, we must take the scientific development view as the guide. Establish a complete energy legal system and perfect energy legal system. The structure of this paper includes three parts: introduction, subject and conclusion. The main part includes four chapters. The first chapter summarizes the basic theories of low-carbon economy and energy law. The relationship between low-carbon economy and energy legal system, the low carbonization of China's energy legal system, and the three theoretical bases of low-carbon energy legal system are introduced, which are the transformation of ecological ethics and energy law, the externality theory and the environmental right theory. These theories lay a theoretical foundation for the low carbonization of China's energy legal system. The second chapter analyzes the current situation of China's energy legal system, introduces the present situation of our country's energy law, and analyzes the contents of our main energy legal system. The third chapter is a comparative study of the domestic and foreign energy legal systems. Firstly, it summarizes the general situation of energy laws in Britain, the United States, Japan, Germany and other countries, and then applies the comparative study. The method of empirical analysis is to analyze the domestic and foreign energy legal system, and conclude that the foreign excellent system can be used for reference in our country. Chapter 4th, This paper puts forward some suggestions on how to perfect the energy legal system of our country under the background of low carbon economy, using the experience of advanced legislation abroad for reference and combining with the actual situation of our country, and puts forward some possible and effective suggestions on how to perfect the legal system of energy resources in our country under the background of low carbon economy. In order to improve the legal system of energy, the sustainable utilization of energy and the development of low-carbon economy, we can make a little contribution to the development of low-carbon economy.
