【摘要】：环境影响评价制度是现代国家普遍确立的一项环境保护法律制度，公众参与作为环境影响评价程序的重要环节，对保障环境影响评价的公正性，，环境决策民主化，确保境环境影响评价预防目的实现有重大意义。目前我国经济快速发展、城镇化进程加剧，也加深环境资源争夺的白日化，导致环境纠纷的日益增多。通过构建、完善公众参与的框架，细化公众参与的制度规则，即是保障公众的知情权、参与权，也是构建合理环境资源分配利用的有效途径。通过有效的公众参与可以平衡建设项目投入方的环境成本，在一定程度上提高环境资源的成本价值，为环境资源可持续利用发展提供保障。同时还可以促进环境民主的发展，防止有关部门单方面的环境决策对环境造成的危害。
[Abstract]:Environmental impact assessment (EIA) system is a legal system of environmental protection established in modern countries. As an important part of environmental impact assessment process, public participation is important to safeguard the fairness of environmental impact assessment and democratize environmental decision-making. It is of great significance to ensure the realization of the preventive purpose of environmental impact assessment. At present, the rapid development of our economy, the intensification of the urbanization process, and the deepening of the competition for environmental resources also lead to the increasing number of environmental disputes. Perfect the framework of public participation, refine the system rules of public participation, that is, protect the public's right to know, participate in the right, It is also an effective way to construct rational distribution and utilization of environmental resources. Through effective public participation, it can balance the environmental cost of the input side of the construction project and improve the cost value of the environmental resources to a certain extent. At the same time, it can promote the development of environmental democracy and prevent the environmental harm caused by unilateral environmental decision-making.
