【摘要】： 目前,森林资源产权制度已经成为学界广泛关注的一个热点问题。对森林资源产权的研究有助于进一步完善我国森林资源产权制度理论和为正在进行的林权改革提供强大的理论支持。首先,本文对森林资源产权问题进行分析,论证了构建森林资源产权制度的理论支点。认为森林资源产权制度应当反映人、自然和环境之间的客观必然联系;以可持续发展理论为指导是森林资源产权制度建设的必由之路;解决森林资源危机问题应将市场手段与政府干预有机结合;森林资源产权制度应当突出秩序、效益和公平价值。接着从法律本体的角度论述了森林资源产权的基本理论。认为森林资源产权是由森林资源所有权和利用权构成的权利束;森林资源产权总体上属于私权;森林资源产权法律关系的主体因森林资源产权的种类不同而有异,森林资源产权的客体是森林资源,森林资源产权法律关系的内容包括法律权利和法律义务。其次,就我国森林资源产权制度基本安排作了较全面的探究。认为森林资源产权制度的起源与森林资源权属制度密不可分,森林资源产权理论与森林资源产权制度随着历史的发展而发展;森林资源的稀缺性、技术进步和人们对资源需求的变化是森林资源产权制度演变的根本原因;建立森林资源产权制度既要借鉴历史又要以现实为依据;森林资源具有使用价值和价值,森林资源产权交易是必要的;国家应当垄断森林资源产权交易一级市场,开放二级市场,并建立森林资源产权价格监督管理制度;森林资源产权交易因市场不同而有所不同。最后,通过前述各章的理论分析,指出我国森林资源危机的制度性原因,并针对中国现行森林资源产权法律制度的缺陷与冲突,提出了加强理论研究与实践探索,引导和规范森林资源产权制度建设;建立市场化森林资源产权管理模式,实现森林资源使用权与经营权市场化;实现森林资源所有权多元化,建立森林资源生态补偿机制等完善我国森林资源产权制度的对策性建议。
[Abstract]:At present, The research on the property rights of forest resources is helpful to further improve the theory of property rights of forest resources in China and to provide strong theoretical support for the ongoing reform of forest property rights. First of all, this paper analyzes the property rights of forest resources, demonstrates the theoretical fulcrum of constructing the system of property rights of forest resources, and thinks that the system of property rights of forest resources should reflect the objective and inevitable relationship between human beings, nature and environment. Guided by the theory of sustainable development, it is the only way to construct the property right system of forest resources; to solve the problem of forest resources crisis, the market means should be combined with government intervention, and the system of property rights of forest resources should give prominence to order. The basic theory of forest resource property right is discussed from the angle of legal ontology. It is considered that forest resource property right is a bundle of rights composed of forest resource ownership and utilization right, and forest resource property right belongs to private rights in general. The subject of legal relationship of forest resource property right is different because of different kinds of forest resource property right. The object of forest resource property right is forest resource, and the content of legal relation of forest resource property right includes legal right and legal obligation. Secondly, the basic arrangement of the property right system of forest resources in our country is discussed comprehensively. It is considered that the origin of the property right system of forest resources is closely related to the ownership system of forest resources. The theory of forest resources property rights and the system of forest resources property rights develop with the development of history, the scarcity of forest resources, the technological progress and the change of people's demand for resources are the fundamental reasons for the evolution of forest resources property rights system. The establishment of forest resources property rights system should be based on both history and reality; forest resources have use value and value, so it is necessary to trade forest resources property rights; the state should monopolize the primary market of forest resources property rights transactions. Open the secondary market and establish the price supervision and management system of forest resources property rights, and the transaction of forest resources property rights varies with the market. Finally, through the theoretical analysis of the preceding chapters, this paper points out the institutional causes of the forest resources crisis in China, and puts forward the strengthening of theoretical research and practical exploration in view of the defects and conflicts of the current legal system of forest resources property rights in China. Guiding and standardizing the construction of forest resource property right system, establishing market-oriented management mode of forest resource property right, realizing marketization of forest resource right of use and management, realizing diversification of forest resource ownership, The countermeasures to improve the property right system of forest resources in China are to establish the ecological compensation mechanism of forest resources.
