【摘要】：当前,生态旅游已经成为旅游业中发展最快的分支和旅游业发展的趋势。生态旅游的快速发展,为我国经济发展注入了新鲜血液,同时也引发了一系列的环境、社会问题。建立健全生态旅游法律制度对于我国生态旅游健康发展具有重要的意义。? 生态旅游是以生态学原则和可持续发展思想为指导,以自然生态环境和相关文化区域为场所,让旅游者在体验、了解、欣赏自然和文化的同时受到环境教育,谋求人与自然的和谐共处,实现旅游资源的可持续利用和旅游业的可持续发展的一种旅游形式。生态旅游立法不再是单纯的管理生态旅游行业的法律,作为现代环境立法,它更是保障和促进生态旅游发展的法律。促进型立法作为一种新型的立法形式,秉承着新的立法理念,迎合了现代立法模式的要求。促进型立法在西方发达国家的生态旅游立法中都得到了体现并取得了一定的成效。基于实现我国旅游领域环境正义的要求、我国旅游业可持续发展的要求和完善我国旅游法制的要求,我国有必要加快制定生态旅游促进型法律的进程。我国进行生态旅游促进立法,应当做好两个方面的工作。一是选择立法模式。现阶段我国已经具备了制定生态旅游促进基本法及其配套法律法规的条件,从我国具体国情出发,我国进行生态旅游促进立法应该坚持在宪法的指导下,采取制定生态旅游促进基本法和生态旅游促进型配套法律法规的立法模式。二是明确立法内容。生态旅游活动涉及三方主体,因此进行生态旅游促进立法应该明确相关主体的权利义务关系,在此基础之上方能构建促进生态旅游发展的各项制度,包括建立健全环境教育制度、建立生态旅游认证制度、建立生态旅游环境责任保险制度和完善公众参与制度等。
[Abstract]:At present, ecotourism has become the fastest growing branch of tourism and the trend of tourism development.The rapid development of ecotourism has injected fresh blood into the economic development of our country, at the same time, it has also caused a series of environmental and social problems.It is of great significance to establish and perfect the legal system of ecotourism for the healthy development of ecotourism in China.Ecotourism is guided by ecological principles and sustainable development thoughts, taking natural ecological environment and related cultural areas as places, so that tourists can receive environmental education while experiencing, understanding and appreciating nature and culture.It is a form of tourism to seek harmonious coexistence between man and nature and to realize the sustainable utilization of tourism resources and the sustainable development of tourism.The legislation of ecotourism is no longer the law of managing the ecotourism industry, but also the law of protecting and promoting the development of ecotourism as a modern environmental legislation.As a new type of legislation, promotive legislation caters to the requirements of modern legislative model.Promoting legislation has been embodied in the ecotourism legislation of western developed countries and has achieved certain results.Based on the requirements of realizing environmental justice in the field of tourism, the requirements of sustainable development of tourism in China and the requirement of perfecting the legal system of tourism in China, it is necessary for China to speed up the process of making the law of promoting ecotourism.Our country carries on the ecotourism promotion legislation, should do well two aspects work.The first is to choose the legislative model.At the present stage, China already has the conditions for formulating the basic Law for Ecotourism Promotion and its supporting laws and regulations. Proceeding from the specific conditions of our country, we should adhere to the guidance of the Constitution in carrying out ecotourism promotion legislation in our country.Adopt the legislative model of making the basic law of eco-tourism promotion and the supporting laws and regulations of ecotourism promotion type.The second is to clarify the content of legislation.The ecotourism activities involve three parties, so the legislation of ecotourism promotion should make clear the relationship between the rights and obligations of the related subjects, on the basis of which, we can construct various systems to promote the development of ecotourism.It includes the establishment of environmental education system, the establishment of eco-tourism certification system, the establishment of eco-tourism environmental liability insurance system and the improvement of public participation system.
