西部旅游业环境公益诉讼制度研究

【摘要】：创建西部旅游业环境公益诉讼对西部旅游业实现环境法治具有保障作用,对西部旅游地政府管理具有监督和促进作用,对西部旅游业环境公益救济及环境侵权行为则具有预防作用。创建西部旅游业环境公益诉讼制度有其必要性和可行性,应克服法律适应性和法律制度设计方面的难点,从立法形式和制度设计方面开辟旅游资源保护的司法救济途径。
[Abstract]:The establishment of environmental public interest litigation of tourism industry in western China can guarantee the realization of environmental rule of law in western tourism industry, and supervise and promote the government management of tourism destination in western China.Environmental public welfare relief and environmental tort in the western tourism industry have preventive effect.It is necessary and feasible to establish the western tourism environmental public interest litigation system, which should overcome the difficulties of legal adaptability and legal system design, and open up the judicial relief way of tourism resources protection from the aspects of legislative form and system design.
