机动车单双号常态化限行的环境法治之辨

【摘要】:当前热议的"机动车单双号限行常态化措施"应属于"非以在用车大气污染物排放水平区分"为基础的措施,是以提高道路通行效率的方式间接降低机动车低速行驶或怠速期间对大气环境影响的一种行政管制措施,其折射出的依然是行政机关"命令控制"的传统环境行政管理思维。须将机动车环保限行措施纳入以"政府-企业-公众(社会)"互动框架为核心的新型环境法之中,以多元治理克服单一"命令控制"之不足。《大气污染防治法》未来应在实现向第二代环境法转型升级的前提下规范之。
[Abstract]:The "regularization measures for the restriction of single and even number of motor vehicles", which are currently being discussed, should be based on "not based on the distinction of emission levels of air pollutants from in-use vehicles". It is an administrative control measure to indirectly reduce the impact on the atmosphere environment during the period of low speed driving or idle speed of motor vehicles by improving the efficiency of road traffic, which reflects the traditional thinking of environmental administration of administrative organs "order control". The environmental restrictions on motor vehicles should be incorporated into the new environmental law with the framework of "Government-business-public (society)" interaction as the core, The "Air pollution Prevention and Control Law" should be regulated in the future on the premise of transforming and upgrading to the second generation environmental law.
