《生物质能促进法》立法研究

【摘要】： 生物质能指利用生物质作为原料生产出的各种形式的能源,表现形式有热能、电能、沼气、生物燃料等。随着科技技术的发展,生物质能将在未来的可持续能源系统中占有重要地位。因此,世界不少国家都在大力发展生物质能。我国是人口众多的农业国家。生物质能在我国的能源结构中占有相当重要的地位,尤其在广大农村地区,生物质能曾经是最主要的能源。随着科学技术的发展,生物质可以高效地加以利用,生产出清洁燃料和电力,以替代煤炭、石油、天然气和其它化石燃料。开发利用生物质能,有益于我国的可持续发展、环境保护和能源安全。我国在生物质能开发利用方面取得了可喜的成绩,为进一步发展奠定了良好的基础,但是,从总体来看,与先进国家相比还有很大的差距。为了推进我国生物质能的产业发展,政府必须为其创造出良好的法制环境。虽然政府已经出台了一些激励性的扶持政策,但由于至今仍无专门立法,致使我国生物质能的法律框架难以建立。鉴于此,笔者运用理论联系实际、历史考察、比较分析等方法,指出我国发展生物质能的意义,介绍了国内外发展生物质能的政策和法律,提出了制定《生物质能促进法》并构建我国生物质能法律框架的建议。对于这部专门法,笔者将重点研究立法目的、立法原则、法律制度和法律措施等几方面。
[Abstract]:Biomass energy refers to various forms of energy produced by biomass as raw materials. The forms of energy are heat energy, electric energy, biogas, biofuel and so on. With the development of science and technology, biomass energy will play an important role in the future sustainable energy system. Therefore, many countries in the world are vigorously developing biomass energy. China is an agricultural country with a large population. Biomass energy plays an important role in the energy structure of China, especially in rural areas. With the development of science and technology, biomass can be efficiently used to produce clean fuel and electricity instead of coal, oil, natural gas and other fossil fuels. The exploitation and utilization of biomass energy is beneficial to the sustainable development, environmental protection and energy security of our country. China has made gratifying achievements in the development and utilization of biomass energy, which has laid a good foundation for further development. However, on the whole, there is still a big gap compared with the advanced countries. In order to promote the development of biomass energy industry in China, the government must create a good legal environment for it. Although the government has issued some encouraging support policies, because there is no special legislation, it is difficult to establish the legal framework of biomass energy in our country. In view of this, the author points out the significance of developing biomass energy in China by means of combining theory with practice, historical investigation, comparative analysis and so on, and introduces the policies and laws of developing biomass energy at home and abroad. The suggestion of establishing the law of biomass energy promotion and constructing the legal framework of biomass energy in China is put forward. For this special law, the author will focus on legislative purpose, legislative principles, legal system and legal measures.
