中国排污权交易制度的法律问题研究

【摘要】： 20世纪90年代,以构建和谐社会和循环经济发展模式为目标的努力已经在国际社会蔚然成风。而建立在可持续发展理念和资源市场化配置规则基础上的排污权交易制度是上述两种经济发展模式应用于环保领域的生动诠释。作为一种理念变革和制度创新产物的排污权交易制度,笔者认为排污权交易制度的研究对中国环境保护进而影响金融发展方面具有很大的理论价值和现实意义。 本文分为导言和正文两个部分。 导言部分,说明撰写本文的目的,即通过描述当今国际社会承受的巨大环境压力以及中国经济社会发展所面临的经济转型问题,导出对排污权交易制度的研究意义,进而明确排污权交易制度在解决上述问题中的重要地位。同时,总结国际国内理论实践经验,提出一些排污权交易制度的构建中需要注意的问题,希望能对我国的排污权交易制度的建设提供一定程度的有益参考和借鉴。 正文部分由七章组成: 第一章以排污权交易制度的起源和经济理论基础为切入点,介绍了排污权在美国发展的政策历程,并分析了排污权交易制度的理论基础。 第二章重点探讨了排污权的法律性质。从排污权的特殊性出发,与传统物权相对比,进而探讨排污权的法律属性,最后给出了排污权的法律界定。 第三章分析了排污权交易制度在国际和国内两方面的具体实践,从而引出排污权交易制度的构建所面临的意识形态和科技、管理方面的阻碍。 第四章从环境容量和排污许可对排污权的初始取得出发,介绍了目前存在的排污权初始取得的基础和制度。 第五章从监管机构、准入规则、交易程序以及监管制度等方面出发,并结合中国排污权交易制度的实际情况,对中国排污权交易制度的二级市场进行了重点阐述。 第六章通过对现今社会发展相对较为完善的碳金融相关制度的研究,希望能对整个排污权交易制度的发展起到借鉴作用,最终建立起覆盖面更广的减排制度。 第七章从法律规制、分配机制、交易场所和监管机制对我国的排污权交易制度提出个人建议,以期对我国当今排污权交易制度建构提供借鉴。
[Abstract]:In the 1990s , the efforts to build a harmonious society and cycle economic development model have become more and more important in the international community . The establishment of the system of pollution right trading on the basis of sustainable development concept and market - oriented allocation of resources is a vivid interpretation of the two kinds of economic development models applied in the field of environmental protection . As a kind of pollution trading system with the idea change and the system innovation product , the author thinks that the research on the system of pollution right trading has great theoretical and practical significance to the environmental protection of China and the financial development .



This paper is divided into two parts : Introduction and Body .



The introduction part , explains the purpose of this paper , that is , by describing the great environmental pressure that the international community bears today and the economic transformation of China ' s economic and social development , the research significance of the trading system of pollution right is derived , and then the problem that the trading system of the pollution right is put forward in order to solve the above - mentioned problems . At the same time , the problems that need to be paid attention in the construction of the trading system of pollution right are put forward , and it is hoped that the construction of the trading system of pollution right in China can provide some useful reference and reference .



The body part consists of seven chapters :



In the first chapter , based on the origin and the economic theory of the trading system , the paper introduces the policy course of the pollution right in the United States , and analyses the theoretical basis of the trading system of pollution power .



The second chapter focuses on the legal nature of pollution discharge right . From the particularity of pollution discharge , the author discusses the legal property of pollution right , and finally gives the legal definition of pollution discharge right .



The third chapter analyzes the concrete practice of the trading system of pollution right in both the international and the country , thus leading out the ideological and technological and administrative obstacles faced by the construction of the trading system of the pollution right .



The fourth chapter starts from the initial acquisition of pollution right from environmental capacity and pollution discharge permission , and introduces the basis and system of the initial acquisition of pollution right now .



In the fifth chapter , from the aspects of supervision organization , admission rules , transaction procedure and supervision system , and combining with the actual situation of China ' s sewage right trading system , the second - level market of China ' s sewage right trading system is expounded .



In the sixth chapter , through the study of the relatively perfect carbon finance related system of the present social development , it is hoped that the development of the whole sewage trading system can be used as a reference , and a wider emission reduction system will be established finally .



The seventh chapter puts forward personal suggestions from the legal regulation , distribution mechanism , trading place and supervision mechanism to China ' s pollution right trading system , with a view to providing reference for the construction of our country ' s current pollution trading system .
