我国水权交易立法问题研究

【摘要】： 水是基础性的自然资源和战略性的经济资源,是人类生存的生命线,也是经济社会可持续发展的重要物质基础。虽然我国水资源总量丰富,但是人均占有量只相当于世界人均占有量的四分之一,并且由于过去粗放的经营方式,造成水资源大量的浪费与污染。黄河年年断流、工业季节性停产、居民用水连连告急,这一串串公共事件不断警示我们:水资源的稀缺与匮乏已然成为我国经济可持续发展的一大瓶颈。因此,建设节水型社会,珍惜与保护水资源便成为当前十分紧迫的任务。建设节水型社会,保护水资源就必须建立健全适合我国国情的水权交易制度。文章提出了水权交易的定义并对其进行了分类,明确了水权交易的基本原则,分析了实行水权交易的意义。在阐明这些基本理论之后,提出了我国水权交易存在水权交易主体不明确、水权交易客体未厘定、水权交易市场弊端重重等缺陷。并结合我国国情,在借鉴澳大利亚、美国、俄罗斯等国家的先进经验的基础上,提出了明确水权交易主体、界定水权交易客体以及克服水权交易市场弊端等完善水权交易的建议。
[Abstract]:Water is the basic natural resources and strategic economic resources. It is the lifeline of human survival and an important material basis for the sustainable development of economy and society. Although the total amount of water resources in China is rich, the per capita possession is only 1/4 of the world's per capita share, and the water resources are caused by the extensive operation in the past. There is a lot of waste and pollution in the source. The annual disconnection of the Yellow River, the industrial seasonal shutdown, and the emergency of water consumption, this series of public events constantly warn us that the scarcity and lack of water resources have become a major bottleneck for the sustainable development of our economy. Therefore, it is very urgent to build a water-saving society, and to cherish and protect the water resources. To build a water-saving society and protect water resources, we must establish and improve the water rights trading system suitable for the national conditions of our country. The article puts forward the definition of water right transaction and classifies it, clarifies the basic principles of water rights trading and analyzes the significance of the water right transaction. After clarifying these basic theories, the water right is put forward in our country. On the basis of the advanced experience of the countries of Australia, the United States and Russia, the subject of water right trading, the object of water right trading and the abuse of the water rights trading market are put forward on the basis of the advanced experience of Australia, the United States and Russia. Advice on improving water rights trading.
