以环评文件质量管理为核心的环评监管法律机制的思考

【摘要】：环评制度自20世纪70年代施行以来,在预防环境污染和生态破坏、促进可持续发展战略的实施方面发挥了重要作用,但是该制度施行过程中也存在一些问题,引发了社会的关注甚至质疑。本文就环评监管法律机制的困境及其原因进行分析,研究探讨环评制度以审批制为核心调整为以环评文件质量管理为核心的必要性和可行性,并以环评文件质量管理为核心,提出完善环评管理措施与环评文件质量责任,充分征求公众意见,加强环评事中事后监管,以及完善环评监管法律机制的对策建议。
[Abstract]:Since its implementation in the 1970s, the EIA system has played an important role in preventing environmental pollution and ecological destruction and promoting the implementation of the strategy of sustainable development. However, there are still some problems in the implementation of the system. Has aroused the social concern and even questions. This paper analyzes the predicament of the legal mechanism of environmental impact assessment supervision and discusses the necessity and feasibility of the adjustment of the environmental impact assessment system from the examination and approval system to the quality management of the environmental impact assessment documents, and the quality management of the environmental assessment documents as the core. The paper puts forward some countermeasures and suggestions to perfect the management measures and the quality responsibility of the EIA documents, to solicit public opinions, to strengthen the supervision after the EIA, and to perfect the legal mechanism of the EIAs supervision.
