石羊河流域水资源保护立法问题研究

【摘要】： 石羊河流域是西部地区生态环境最为脆弱的地区之一。如何采用行政、经济、工程、科技、法律等手段、措施拯救石羊河流域的生态环境是一项具有挑战性的系统工程。而石羊河流域生态环境问题的关键问题是“水资源”的问题。在实证调研的基础上,本文从石羊河流域水资源保护法律体系的角度出发,研究了立法中存在的若干问题,并提出了自己的若干建设性意见。本文正文部分主要分为四部分: 第一章:石羊河流域的概况。在这一部分主要对石羊河流域生态环境的现状进行了分析,为下面的理论分析做好必要铺垫。第二章:石羊河流域水资源保护立法现状。在这一部分,主要对石羊河流域水资源保护立法的必要性、立法保护的现状进行了探讨。第三章:石羊河流域水资源保护立法中存在的问题与建议。在这一部分对石羊河流域水资源保护立法上存在的若干问题进行了分析。比如对宏观法律层面的系统性、协调性;中观法律问题中的水资源管理体制、水权制度、地下水保护;微观法律层面的祁连山生态保护、民勤生态保护等问题进行了必要的探讨。在一些方面提出了自己的若干建议。第四章:在这一部分,首先对“循环经济”的基本原理以及在我国的发展做了必要的讨论。接着对石羊河流域推行“中水回用”研究以及立法的必要性进行了分析,并提出了若干具体的立法建议。
[Abstract]:Shiyang River Basin is one of the most fragile ecological areas in the western region. How to use administrative, economic, engineering, science and technology, law and other measures to save the ecological environment of Shiyang River basin is a challenging system engineering. The key problem of ecological environment in Shiyang River Basin is water resources. On the basis of empirical investigation, this paper studies some problems existing in legislation and puts forward some constructive suggestions from the point of view of the legal system of water resources protection in Shiyang River Basin. The main body of this paper is divided into four parts: chapter one: general situation of Shiyang River Basin. In this part, the present situation of ecological environment in Shiyang River basin is analyzed, which is necessary for the following theoretical analysis. Chapter two: the current situation of water resources protection legislation in Shiyang River Basin. In this part, the necessity and current situation of water resources protection legislation in Shiyang River Basin are discussed. Chapter three: problems and suggestions in legislation of water resources protection in Shiyang River Basin. In this part, some problems existing in the legislation of water resources protection in Shiyang River Basin are analyzed. For example, systematic and coordinated macro-legal aspects; water resources management system, water rights system, groundwater protection in meso-legal issues; ecological protection of Qilian Mountains at the micro legal level, The ecological protection of Minqin is discussed. Some suggestions are put forward in some aspects. Chapter four: in this part, the basic principle of circular economy and its development in China are discussed. Then the necessity of carrying out the research and legislation of "reclaimed water reuse" in Shiyang River basin is analyzed, and some specific legislative suggestions are put forward.
