甘南州生态产业发展的政策法律研究

【摘要】：甘南藏族自治州位于青藏高原东北边缘,是“黄河蓄水池”、“中华水塔”的重要组成部分,其生态功能和地位可以用“天然长城”、“生态门户”来概括,在涵养和补给黄河水源、调节气候、保持水土、维护生物多样性方面具有十分重要的特殊功能和生态地位。国家十一五规划中已将甘南黄河重要水源补给区纳入限制开发类主体功能区并明确了区域功能定位及发展方向,其发展方向是环境保护优先,因地制宜发展环境资源可承载的特色产业。作为经济欠发达地区,发展生态产业是甘南州实现生态保护和经济发展双赢的最佳选择。近年来国家在甘南投资了诸多环境项目,2007年《甘肃甘南黄河重要水源补给区生态保护与建设规划》正式启动,该规划投资总达44.51亿元,生态产业发展是其中的一个子项目之一,该规划为甘南州生态建设以及生态产业发展奠定了基础。2009年甘南州委、州政府提出了生态立州的发展理念,此外,丰富的自然资源和传统藏区文化使甘南州具有发展生态产业的有利条件和独特优势。发展具有当地特色的生态产业是甘南生态经济建设的关键,而其发展有赖于政策法律的保障。因此在甘南州因地制宜地发展生态产业并进行相关的政策法律探究具有十分深远的现实意义。本文通过文献搜集、比较、田野调查等方法,在查阅大量国内外有关生态产业立法及其相关文献资料的同时利用自己家住甘南的便利条件进行了当地调研,调查甘南经济基础,生态产业现状及其相关的政策法律规定,在大量文献调研的基础上,去粗取精地开展具有自己特色的论文研究,进而分析总结甘南州在生态产业发展过程中所面临的困境从而分析比较得出自己的结论,并提出完善生态产业的政策法律并进一步发展甘南州生态产业的的对策。
[Abstract]:Gannan Tibetan Autonomous Prefecture, located on the northeast edge of the Qinghai-Tibet Plateau, is an important part of the Yellow River Reservoir and the Chinese Water Tower. Its ecological function and status can be summarized as "natural the Great Wall" and "ecological portal". It has a very important special function and ecological status in conserving and resupplying the water sources of the Yellow River, regulating the climate, conserving water and soil, and maintaining the biodiversity of the Yellow River. In the 11th Five-Year Plan of China, the important water supply area of the Yellow River in Gannan has been brought into the main function area of restricting the development of the Yellow River, and the orientation and development direction of the regional function has been defined, the development direction of which is the priority of environmental protection. According to local conditions, the development of environmental resources can bear the characteristics of industry. As an underdeveloped region, the development of ecological industry is the best choice to realize ecological protection and economic development in Gannan. In recent years, the state has invested in many environmental projects in Gannan. In 2007, the "Ecological Protection and Construction Plan for the important Water supply area of the Yellow River in Gannan, Gansu Province" was officially launched. The total investment in this program is 4.451 billion yuan, and the development of ecological industry is one of the sub-projects. The plan laid the foundation for ecological construction and the development of ecological industry in Gannan Prefecture. In 2009, the Gannan State Committee and the state government put forward the concept of ecological state development, in addition, Rich natural resources and traditional Tibetan culture make Gannan have favorable conditions and unique advantages for the development of ecological industry. The development of ecological industry with local characteristics is the key to the construction of ecological economy in Gannan, and its development depends on the guarantee of policy and law. Therefore, it is of great practical significance to develop ecological industry in Gannan state according to local conditions and to explore relevant policies and laws. By means of literature collection, comparison, field investigation and so on, this paper, while consulting a large number of domestic and foreign relevant ecological industry legislation and related literature materials, has carried on the local investigation by using its own convenient conditions of living in Gannan, and investigated the economic base of Gannan. The current situation of ecological industry and its related policies and laws, on the basis of a large number of literature research, carry out the research with its own characteristics on the basis of a large number of documents. Then the paper analyzes and summarizes the dilemma that Gannan faces in the process of ecological industry development, and then analyzes and compares its own conclusions, and puts forward the policy and laws of perfecting ecological industry and the countermeasures for further development of ecological industry in Gannan.
