论环境信访制度的完善

【摘要】：环境信访制度是一项具有中国特色的具有政治和环保色彩的法律制度,它在发挥积极作用的同时也产生了许多问题。当前,有效解决环境信访问题及环境信访制度问题的路径就是将环境信访纳入法治化的轨道,实现环境信访的法治化。文章内容分为四部分：第一部分绪论。该部分概括地阐述了环境信访制度研究的背景、国内外研究状况及研究意义。第二部分环境信访立法现状分析。该部分主要对我国现行的环境信访制度进行概述,内容包括：第一节介绍了环境信访的概念、环境信访的性质及环境信访制度的作用,为进一步理解和具体研究环境信访制度打下基础。第二节阐释了我国环境信访制度的立法现状,介绍了《信访条例》和《环境信访办法》的修订背景、内容及其立法的主要内容。通过介绍、说明,我国现行环境信访制度的法制轮廓逐渐清晰。第三节分析了环境信访制度存在的缺陷,具体分析了《信访条例》、《环境信访办法》存在的立法不足。第三部分环境信访制度运行实践。该部分考察了环境信访制度在实践中的运行状况。通过考察分析,证实了环境信访制度在实践中的运行具有两个问题：一是环境信访制度实施效果喜忧参半；二是环境信访制度实施面临诸多困境。第四部分完善环境信访制度的思考。针对上述环境信访制度存在的问题,该部分以完善环境信访制度为落脚点,提出要以环境信访法治化作为完善环境信访制度的宏观思路,在此理念下,并具体化为五个途径：1.环境信访的法律制度之法治化；2.环境信访行为之法治化；3.环境信访公权力之法治化；4.环境信访权利之法治化；5.环境信访法律主体之法治化。
[Abstract]:Environmental petition system is a political and environmental protection legal system with Chinese characteristics. At present, the effective way to solve the problem of environmental petition and environmental petition system is to bring environmental petition into the track of rule of law and to realize the legalization of environmental petition and visit. The article is divided into four parts: the first part is an introduction. In this part, the background, research status and significance of environmental petition system are summarized. The second part analyzes the current situation of environmental petition legislation. This part mainly summarizes the current environmental petition system in China, including: the first section introduces the concept of environmental petition, the nature of environmental petition and the role of environmental petition system. For further understanding and specific study of environmental petition system lay the foundation. The second section explains the current legislative situation of the environmental petition system in China, and introduces the background, content and main content of the revision of the "regulations on Letters and visits" and the "measures of Environmental Letters and visits". Through the introduction, it shows that the legal outline of the current environmental petition system in China is gradually clear. The third section analyzes the defects of the environmental petition system, and analyzes the deficiency of legislation in the regulations of letter and visit and the method of Environmental Letters and visits. The third part is the practice of environmental petition system. This part examines the operation of environmental petition system in practice. Through investigation and analysis, it is proved that there are two problems in the operation of environmental petition system in practice: one is that the implementation of environmental petition system is mixed, the other is that the implementation of environmental petition system faces many difficulties. The fourth part is about perfecting the environmental petition system. In view of the problems existing in the environmental petition system mentioned above, this part takes the perfection of the environmental petition system as its foothold, and puts forward the macro idea of perfecting the environmental petition and visiting system by law. Under this idea, it is concretized into five ways: 1. The legalization of the legal system of Environmental Letters and visits. The legalization of Environmental Letters and visits. Environmental petition public power of the rule of law no. 4. The legalization of the right of environmental petition. The legalization of the subject of environmental petition law.
