中英实验动物法律制度比较研究

【摘要】： 实验动物科学是现代科学技术的重要组成部分,是生命科学的基础和重要支撑条件,是活的试剂,是衡量现代生命科学研究水平的重要标志。许多领域的科学研究和生产应用,都离不开实验动物。实验动物在为人类的科学研究做出了极大贡献之后,终于得到了世界的普遍重视。目前,世界上已有多个国家和国际组织制定了实验动物方面的法律、法规,并把实验动物问题与国际贸易和学术交流紧密联系在一起。在英国,实验动物的法制建设非常完善,在保证了本国实验动物产业科学、有序发展的同时,也促进了生命科学的高速发展。随着自然科学,特别是生物医药产业的发展,我国实验动物科学取得了长足的进步。但是我国在实验动物立法方面的完善程度,还与发达国家有一定的差距。本文首先对实验动物这一概念进行了阐述,科学界定了实验动物的定义、实验动物的分类、作用。而后通过概述中英两国实验动物工作的进展和法制建设等问题,介绍了两国实验动物工作的历程和立法现状。而后,分别对两国实验动物从业人员资格的管理制度、两国实验动物的生产供应制度、两国实验动物管理制度、实验动物福利制度等方面进行了深层次的比较研究,旨在通过比较两国实验动物法律制度的异同,借鉴英国实验动物法律制度的先进之处,提出加强和完善我国实验动物法律制度的建议。
[Abstract]:Experimental animal science is an important part of modern science and technology, is the foundation and important support condition of life science, is a living reagent, and is an important symbol to measure the level of modern life science research. Many fields of scientific research and production applications, are inseparable from experimental animals. After making great contributions to the scientific research of human beings, experimental animals have finally gained universal attention in the world. At present, many countries and international organizations in the world have formulated laws and regulations on experimental animals, and have closely linked the problems of laboratory animals with international trade and academic exchanges. In Britain, the legal construction of experimental animals is very perfect, which not only ensures the scientific and orderly development of domestic laboratory animal industry, but also promotes the rapid development of life science. With the development of natural science, especially biomedical industry, experimental animal science in China has made great progress. However, there is still a certain gap between China and developed countries in the perfection of experimental animal legislation. In this paper, the concept of experimental animal is described, and the definition of experimental animal, the classification and function of experimental animal are scientifically defined. Then, the progress of experimental animal work and the legal system construction in China and Britain are summarized, and the course and legislative status of experimental animal work in the two countries are introduced. Then, the management system of the qualification of laboratory animal practitioners, the production and supply system of experimental animals, the management system of experimental animals, and the welfare system of laboratory animals in the two countries are studied respectively. The purpose of this paper is to compare the legal systems of laboratory animals between the two countries, draw lessons from the advanced aspects of the legal system of experimental animals in Britain, and put forward some suggestions for strengthening and perfecting the legal system of experimental animals in China.
