企业环境信息强制公开法律问题研究

【摘要】:企业环境信息强制公开是环境信息公开制度中的一项重要部分,企业环境信息的有效公开是公众参与环境治理的基本前提。企业环境信息强制公开涉及两个方面的主体,一是企业环境信息的公开方,另一方是接受企业环境信息的相对方。 近些年来,我国发生了一系列重大环境突发事件,造成了重大的人员伤害和财产损失。究其原因,企业环境信息强制公开制度的缺失显得至关重要。我国企业环境信息强制公开的主体、内容、方式以及制度保障上存在着漏洞,成为相关利益者的挡箭牌,也造就公众参与环境治理的低参与度。这一制度的缺失不仅损害了公众的相关环境权益,也造成了自然环境资源的破坏,因此,发展与完善企业环境信息强制公开制度势在必行。 对于问题的解决,本文首先从界定企业环境信息强制公开开始,其次通过明确企业环境信息强制公开的公开方与相对方,确立这些主体的权利与义务;在公开的内容上明确各公开方需要公开的企业环境信息内容及例外情形;在公开的方式上,根据不同的公开方主体明确其不同的方式;最后在制度保障上,从公开方的内部与外部因素两个方面提出应采取的保障措施。当然,存在的问题可能远远不止这些,解决的方式也不会只限于此。随着环境科学的发展,环境立法、公众环境权益的日益成熟,企业环境信息强制公开制度也将趋于完善、成熟。
[Abstract]:Compulsory disclosure of enterprise environmental information is an important part of environmental information disclosure system. The effective disclosure of enterprise environmental information is the basic premise of public participation in environmental governance. The compulsory disclosure of enterprise environmental information involves two main bodies, one is the disclosure of enterprise environmental information, the other is the opposite party that accepts the enterprise environmental information. In recent years, a series of major environmental emergencies have occurred in China, resulting in serious personnel injury and property losses. The reason is that the lack of compulsory disclosure system of enterprise environmental information is very important. There are loopholes in the subject, content, method and system guarantee of compulsory disclosure of environmental information in enterprises in our country, which become the shield of relevant stakeholders and bring up the low participation degree of public participation in environmental governance. The absence of this system not only damages the environmental rights and interests of the public, but also results in the destruction of natural resources. Therefore, it is imperative to develop and perfect the compulsory disclosure system of enterprise environmental information. To solve the problem, this paper begins with the definition of mandatory disclosure of enterprise environmental information, and then establishes the rights and obligations of these subjects by defining the open and opposite sides of the compulsory disclosure of enterprise environmental information; In terms of public content, it is clear that each public party needs to disclose the contents and exceptions of enterprise environmental information; in the way of disclosure, according to the different subjects of the public party, it is clear that its different ways; finally, in terms of system protection, This paper puts forward the safeguard measures to be taken from the internal and external factors of the public party. Of course, the problems may be much more than that, and the solution is not limited to this. With the development of environmental science, environmental legislation and the maturation of public environmental rights and interests, the compulsory disclosure system of enterprise environmental information will be perfect and mature.
