矿山地质环境治理恢复保证金法律制度探析

【摘要】：矿产资源是人类发展和生存以及经济发展的重要物质基础和条件,也是国家迅速发展的关键保障。由于矿山是属于国民经济的基础,承担着国民经济稳定运行的重要任务,但是随着矿产资源的开发利用,出现了一系列值得每个人关注和深思的矿山地质环境问题,例如:矿难、采矿区的塌陷、矿山生态破坏和环境污染等种种隐患问题。这不仅影响经济提升,也极其严重的破坏了群众的正常生产生活。因此,政府陆续出台了一些整治矿山地质环境的法律法规,逐步加强我国对矿山地质环境治理与研究,而且指导解决我国出现的矿山地质环境问题。因此在我国矿山地质环境问题受到日渐关注的今天,对矿山地质环境进行治理已经十分紧急。但是由于缺乏足够的经验,矿山地质环境治理仍有不足之处。在当前的环境背景下,到底怎样才能真正的完善矿山地质环境恢复保证金法律制度,是极为严峻的问题。本文选择以矿山地质环境治理恢复保证金法律制度为研究对象,分别从六个部分展开论述。希望通过对这一制度的分析研究,研讨关于矿山地质环境治理的经验与教训,从而为以后的矿山地质环境工作起到些许的作用。本文第一部分是矿山地质环境治理恢复保证金法律制度的概述,该部分主要从矿山地质环境治理恢复保证金入手,对矿山地质环境治理恢复保证金进行理论介绍。并且通过对矿山地质环境治理恢复保证金内涵和特征的分析,进而对矿山地质环境治理恢复保证金法律制度的概念展开论述。对矿山地质环境治理恢复保证金法律制度进行一个初步的理论涉及。本文第二部分是矿山地质环境治理恢复保证金法律制度的理论基础,分别从经济学以及管理学方面阐述矿山地质环境治理恢复保证金法律制度的理论基础。本文第三部分是矿山地质环境治理恢复保证金法律制度的历史进程与现状分析。将矿山地质环境治理恢复保证金法律制度的历史演进过程以及目前的整体现状进行分析,了解我国矿山地质环境治理恢复保证金法律制度发展情况以及到目前的现状。本文第四部分是矿山地质环境治理恢复保证金法律制度的问题及分析。首先对我国矿山地质环境基本问题进行描述,再根据上文所描述的矿山地质环境治理恢复保证金法律制度的现状,进一步详细探讨我国当前矿山地质环境治理恢复保证金法律制度存在的问题,并且对存在的问题进行了详细的阐述。本文第五部分是国外矿山地质环境治理恢复保证金法律制度的简介以及对我国的启示。这一部分是起着承上启下的作用,由于上文讨论了我国矿山地质环境治理恢复保证金法律制度的问题,于是在第五部分比较分析国外几个国家选取了不同大洲不同地区的矿山地质环境治理恢复保证金法律制度,北美洲的美国和加拿大,以及大洋洲的澳大利亚,详细论述三个不同地区的国家分别建立的矿山地质环境治理恢复保证金法律制度,找到其中的可取之处。在结合我国实际矿区发展的情况下,取其精华去其糟粕,将他们国家矿山地质环境治理恢复保证金法律制度的优秀经验吸收。本文的第六部分我国矿山地质环境治理恢复保证金法律制度探索以及完善建议。在论述完其他国家的法律制度经验之后,思考如何改进完善我国我国矿山地质环境治理恢复保证金法律制度。结合上文存在的问题,对国矿山地质环境治理恢复保证金法律制度完善提出有效的路径。
[Abstract]:Mineral resources are an important material basis and condition for human development and survival as well as for economic development, and also a key guarantee for the rapid development of the country.As mines are the foundation of the national economy, they undertake the important task of the stable operation of the national economy. The deep thinking of mine geological environment problems, such as mining accidents, mining area collapse, mine ecological damage and environmental pollution and other hidden dangers. This not only affects the economic promotion, but also seriously damages the normal production and life of the people. Therefore, the government has issued some laws and regulations to improve the mine geological environment, and gradually strengthen our country. It is very urgent to control and study the mine geological environment, and to guide and solve the problems of mine geological environment in our country. So it is very urgent to control the mine geological environment today, because of the lack of sufficient experience. Under the background of the former environment, how to really improve the legal system of the mine geological environment restoration deposit is a very serious problem. This paper chooses the legal system of the mine geological environment restoration deposit as the research object, and discusses it from six parts. The first part of this paper is an overview of the legal system of the mine geological environment restoration deposit. This part mainly starts with the mine geological environment restoration deposit and advances the mine geological environment restoration deposit. The second part of this paper is mine geology. The theoretical basis of the legal system of environmental protection and restoration deposit is expounded from the aspects of economics and management. The third part of this paper is the analysis of the historical process and current situation of the legal system of mine geological environment protection and restoration deposit. This paper analyzes the historical evolution process and the current overall situation of the legal system of restoring deposit, and understands the development and present situation of the legal system of restoring deposit for mine geological environment control in China. The fourth part of this paper is the problems and analysis of the legal system of restoring deposit for mine geological environment control. Based on the description of the basic problems of the mountain geological environment and the present situation of the legal system of the mine geological environment remediation and restoration deposit described above, the existing problems of the legal system of the mine geological environment remediation and restoration deposit in China are further discussed in detail, and the existing problems are elaborated in detail. This part plays a connecting role between the preceding and the following. As the above discussion has been made on the legal system of mine geological environment management and restoration deposit in China, the fifth part makes a comparative analysis of several foreign countries'selection of different continents. The legal system of mine geological environment remediation and restoration deposit in the same area, the United States of America and Canada in North America, and Australia in Oceania are discussed in detail. The legal system of mine geological environment remediation and restoration deposit established by three different countries in different areas is discussed, and the desirable points are found. In this paper, the sixth part of the mine geological environment management and restoration margin legal system in China to explore and improve the legal system and suggestions. Combined with the problems mentioned above, this paper puts forward an effective way to improve the legal system of mine geological environment restoration bond.
