我国能源安全立法问题研究

【摘要】：能源问题是全人类共同关心的问题。纵观人类社会发展的历史,人类文明的每一次进步都伴随着能源的改革和更替。特别在当前,国际油价持续攀升,能源安全再度引起世界各国的普遍关注。 随着中国经济社会的不断发展,对能源的安全也提出了更高的要求,在不久的将来,能源的开采、转换和利用对环境、公众身体健康、全球气候变化、经济发展、国家安全等都会产生巨大的影响。我们必须充分认识到做好能源安全工作的极端重要性,把能源安全工作摆在更加突出的位置下大力气抓实、抓好,特别要加强能源安全立法工作。 能源安全法可以通过法律规范,将能源战略的要求构造成具体可行、富有效力并且可以操作的法律保障制度,为能源战略的实施形成稳定的行为机制。所以,我国可持续的能源战略得以实现的根本还是有赖于能源安全法的进一步完善。 本文从分析中国能源安全立法现状的角度出发,介绍了国际有关能源安全立法的法律规定及对我国能源安全立法的影响,在借鉴国外能源安全立法及政策的先进经验的基础上对我国能源安全立法体系提出完善建议,以期待在法制的环境下,建立有利于优化能源结构、提高能源安全生产水平的机制,推进能源科技自主创新,协调好资源、环境和经济发展的关系,妥善解决能源所面临的一系列问题以保障中国现代化建设的能源需求
[Abstract]:The energy problem is the common concern of all mankind. Throughout the history of human social development, every progress of human civilization is accompanied by the reform and replacement of energy. Especially in the current, the international oil price continues to rise, energy security has once again aroused universal concern around the world. With the continuous development of China's economy and society, higher requirements have been put forward for the security of energy. In the near future, the exploitation, conversion and utilization of energy resources will affect the environment, public health, global climate change, and economic development. National security and so on will have a huge impact. We must fully realize the extreme importance of doing a good job in energy security work, put energy security work in a more prominent position, pay great attention to it, and do a good job, especially in strengthening the work of energy security legislation. The energy security law can construct the requirements of the energy strategy into a practical, effective and operable legal security system through legal norms, and form a stable behavior mechanism for the implementation of the energy strategy. Therefore, the realization of sustainable energy strategy depends on the further improvement of energy security law. From the point of view of analyzing the current situation of China's energy security legislation, this paper introduces the international legal provisions on energy security legislation and its impact on China's energy security legislation. On the basis of drawing lessons from the advanced experience of foreign energy security legislation and policies, this paper puts forward some suggestions for the improvement of our country's energy security legislation system, in order to look forward to the establishment of energy structure in favor of optimizing the energy structure under the environment of legal system. The mechanism for improving the level of energy safety production, promoting independent innovation in energy science and technology, coordinating the relationship between resources, environment and economic development, and properly solving a series of problems faced by energy in order to ensure the energy demand of China's modernization drive.
