环保NGO参与环境行政公益诉讼法律问题研究

【摘要】：近几年，随着中国经济的不断飞速发展，环境问题已经成为政府以及社会公众不得不重视的大问题。污染不断加重，生态环境遭到严重破坏等一系列环境问题的产生，已经严重的影响到了人们的日常生活。环境问题已经成为公众日益关注的社会热点问题之一。但是，由于我国环境保护事业的发展起步较晚，有关环境保护领域的各种法律、法规还不健全，甚至在某些环保领域还有空白。加之，政府部门对环境保护工作的重视程度不够，工作效率不高，责任心不强等因素，导致因政府不履行或怠于履行职责而使公民的环境权益时常受到侵害，作为弱势群体的社会公众无力去保护自己受侵害的环境权益。环保NGO的出现，正在逐步的解决这一难题。环保NGO由于其本身所具有的不同于个人和其他组织的特殊属性，较好的弥补了由个人或其他组织提起环境行政公益诉讼的不足之处。因此，本文从环保NGO参与行政公益诉讼的角度，对我国的环保NGO参与环境行政公益诉讼时的相关法律问题进行了研究。笔者在系统分析了当前我国环保NGO的发展历程以及发展现状的前提下，指出了环保NGO在参与行政公益诉讼过程中存在的障碍，，并借鉴美国、德国的先进经验，结合我国国情，对构建我国环保NGO参与环境行政公益诉讼的法律制度提出了设想。文章提出，首先要保障环保NGO的自身的发展，要从登记设立、资金来源等方面入手，赋予其诉讼的原告资格，并且在诉讼程序上保障其诉权，设立行政前置程序及执行中止程序，明确诉讼费用如何承担，对受案范围、诉讼请求以及撤诉权等相关问题均提出了构建设想。
[Abstract]:In recent years, with the rapid development of Chinese economy, environmental problems have become a big problem that the government and the public have to pay attention to. A series of environmental problems, such as increasing pollution and serious destruction of ecological environment, have seriously affected people's daily life. The environmental problem has become one of the social hot issues which the public pays more attention to day by day. However, due to the late development of environmental protection in China, various laws and regulations in the field of environmental protection are not perfect, even in some areas of environmental protection there is still a blank. In addition, the government departments pay less attention to the environmental protection work, the work efficiency is not high, the responsibility is not strong and other factors, resulting in the government not to perform or to perform their duties, so that the environmental rights and interests of citizens are often infringed. As a vulnerable group, the public is powerless to protect their violated environmental rights and interests. The emergence of environmental protection NGO, is gradually solving this problem. Environmental protection NGO is different from individuals and other organizations because of its own special attributes, which makes up for the deficiencies of environmental administrative public interest litigation initiated by individuals or other organizations. Therefore, from the point of view of environmental protection NGO participating in administrative public interest litigation, this paper studies the relevant legal problems of environmental protection NGO participation in environmental administrative public interest litigation in our country. Based on the systematic analysis of the development course and current situation of environmental protection NGO in China, the author points out the obstacles in the process of participating in administrative public interest litigation, and draws lessons from the advanced experience of the United States and Germany, and combines the national conditions of our country. The legal system of environmental protection NGO participating in environmental administrative public interest litigation is put forward. The article puts forward that first of all, we should protect the development of environmental protection NGO, start with the establishment of registration, the source of funds and so on, give the plaintiff qualification of litigation, and protect his right of action in the litigation procedure. This paper sets up administrative preposition procedure and execution suspension procedure, clarifies how to bear the costs of litigation, and puts forward some constructive ideas about the scope of receiving cases, litigation request and withdrawal right and so on.
