论行政公益诉讼中的“公益”概念

【摘要】："公益"概念是行政公益诉讼制度确立并实施的锁钥。对"公益"的解读应当关注其身处宪法和行政法语境的特殊性,进而可以设计一种递进式的"公益"厘定路径——由形式到实质再到范围限定,从而缓解因概念不确定性带来的权力滥用和讼累风险。首先,形式标准认为违反行政法律规范即违背"公益",其前设在于公益内容仰赖立法形成,以及行政法的公益性。其次,实质标准主张基本权利与国家任务构成"公益"的实质内容,其前设在于"公益"首先是一个宪法层次的概念,以及宪法与行政法的关系。再次,基于诉的利益理论,从必要性与重要性两个方面限定能够进入诉讼程序的"公益"范围。由此确立的"公益"概念,有助于行政公益诉讼的正当性证成和制度设计。
[Abstract]:The concept of "public welfare" is the key to the establishment and implementation of the administrative public interest litigation system. The interpretation of "public welfare" should pay attention to its particularity in the context of the Constitution and administrative law, and then we can design a progressive way to define "public welfare" - from form to substance to scope, so as to alleviate the abuse of power caused by the uncertainty of the concept. First of all, the formal standard holds that violating administrative legal norms means violating "public welfare", which is presupposed by the content of public welfare relying on the formation of legislation and the commonweal nature of administrative law. Thirdly, based on the interest theory of litigation, the scope of "public welfare" which can enter the litigation procedure is limited from two aspects of necessity and importance.
