黑龙江省循环经济立法研究

【摘要】： 伴随着中国经济的腾飞和社会的进步,我们付出了环境污染和自然资源破坏严重的沉痛代价,环境问题已经成为社会所关注的热点问题之一。能否找到一条既能发展经济又能保护环境和资源的经济发展之路已经迫在眉睫,循环经济正是适合我国国情的经济发展之路。我国《循环经济促进法》已于2009年1月1日正式施行,国家首次以法律的形式确定了发展经济的“3R原则”,即减量化、再利用和资源化等基本法律制度。黑龙江省在全国来看经济发展相对滞后,其在工农业生产等产业领域中普遍存在粗放型经济增长模式所带来的弊端,甚至服务行业等第三产业中资源浪费和环境破坏的现象也比比皆是。《黑龙江省国民经济和社会发展第十一个五年规划纲要》指出“坚持依法治省的方针,实施‘五五’普法规划,完善市场主体、市场交易、市场监管、社会管理、可持续发展等方面的法律法规。”要大力“发展循环经济,保护生态环境,加快建设资源节约型和环境友好型社会。”因此说黑龙江省循环经济地方性法规的出台只是时间的问题。本文深入阐释了循环经济基本理论,分析了黑龙江省发展循环经济的优势和意义,进一步研究了国内外相关的循环经济法律规定,继而在研究了我国《循环经济促进法》的基础上借鉴了国内兄弟省市开展循环经济立法的先进经验。最后,对黑龙江省发展循环经济立法进行了设构和建议,分析了黑龙江省循环经济地方性法规的立法重点和具体制度等法律建构层面的具体问题。
[Abstract]:With the rapid development of Chinese economy and social progress, we have paid the heavy price of environmental pollution and natural resources destruction, and environmental problems have become one of the hot issues concerned by the society. It is urgent to find a way of economic development that can develop economy and protect environment and resources. Circular economy is the way of economic development suitable for our country's national conditions. The Circular economy Promotion Law of our country has been put into effect on January 1, 2009. For the first time, the country has determined the "3R principle" for the development of economy by law, that is, the basic legal system, such as reduction, reuse and resourcing. The economic development of Heilongjiang Province is relatively lagging behind in the whole country, and its extensive economic growth pattern in industries such as industrial and agricultural production is widespread. Even the waste of resources and the destruction of the environment in tertiary industries such as service industries are everywhere. The outline of the Eleventh Five-Year Plan for the National Economic and Social Development of Heilongjiang Province points out that "adhere to the principle of administering provinces according to law." The implementation of the 'five-year Plan for the Popularization of laws and regulations, the improvement of the main body of the market, market transactions, market supervision, social management, sustainable development and other aspects of laws and regulations. " We should vigorously "develop circular economy, protect ecological environment, and accelerate the construction of resource-saving and environment-friendly society." Therefore, it is only a matter of time before the local laws and regulations of circular economy in Heilongjiang Province are issued. This paper deeply explains the basic theory of circular economy, analyzes the advantages and significance of developing circular economy in Heilongjiang Province, and further studies the relevant laws and regulations of circular economy at home and abroad. Then, on the basis of studying the circular economy promotion law of our country, we draw lessons from the advanced experience of developing circular economy legislation in our country's brother provinces and cities. Finally, the author constructs and suggests the legislation of circular economy in Heilongjiang Province, and analyzes the legislative emphases and specific systems of the local laws and regulations on circular economy in Heilongjiang Province.
