我国电子废弃物立法研究

【摘要】： 随着电子信息产业的发展,电子废弃物污染问题已不容忽视。电子废弃物的循环利用和处置不仅仅对环境保护和生态安全具有重要意义,也是循环经济发展和建设环境友好型资源节约型社会的要求。虽然我国在电子废弃物处置问题上已制定了一些法律法规,但总体来讲并不完善,导致许多问题无法解决。 本文首先对电子废弃物进行了界定,列举了我国现行规制电子废弃物的法律法规并进行了分析,提出我国电子废弃物现行立法中存在的相关问题。即:立法原则不统一、现行法律、法规冲突、责任体系不完备、相关法律缺失、缺乏经济激励条款。发达国家在电子废弃物立法上均取得了显著的成果,其先进经验有许多值得我国学习和借鉴的地方。日本完备的立法体系,瑞士明确的法规和技术标准以及韩国完善的生产者责任延伸制度都为我国电子废弃物立法提供了相关启示。在研究国外电子废弃物立法先进经验的基础上,重点论述了我国电子废弃物立法构想,包括基本原则、权利义务内容、生产者责任延伸制度和处罚。在立法的基础上提出了对现有法律进行修改以配合电子废弃物立法的协调手段,以及在立法中确立一些经济激励条款,包括税收、信贷、财政等方面提供优惠等。以期为我国电子废弃物立法提供一些有价值的研究成果。
[Abstract]:With the development of electronic information industry, the pollution of electronic waste can not be ignored. The recycling and disposal of electronic wastes is not only of great significance to environmental protection and ecological security, but also to the development of circular economy and the construction of environment-friendly resource-saving society. Although China has made some laws and regulations on the disposal of electronic wastes, it is not perfect, which leads to many problems that can not be solved. Firstly, this paper defines the electronic waste, lists the laws and regulations that regulate the electronic waste in our country, and analyzes the related problems in the current legislation of the electronic waste in our country. Namely: the legislation principle is not unified, the current law, the regulation conflict, the responsibility system is not complete, the related law lacks, lacks the economic incentive clause. The developed countries have made remarkable achievements in the legislation of electronic waste, and their advanced experience is worth learning from in our country. The complete legislation system in Japan, the clear regulations and technical standards in Switzerland and the extended producer responsibility system in Korea all provide relevant enlightenment for the legislation of electronic waste in China. On the basis of studying the advanced experience of foreign electronic waste legislation, this paper focuses on the legislative conception of electronic waste in China, including the basic principles, the content of rights and obligations, the extended system of producer responsibility and punishment. On the basis of the legislation, this paper puts forward the coordination means of amending the existing laws to fit in with the legislation of electronic waste, and establishes some economic incentive clauses in the legislation, including tax, credit, finance and so on. In order to provide some valuable research results for the legislation of electronic waste in China.
