建设雨水集蓄工程资金的相关法律问题研究

【摘要】： 在我国的西北部分地区,主要包括内蒙古高原、黄土高原、四川盆地西缘到云贵高原以西的地区。这部分地区由于自然和历史的原因,极度缺水,据甘肃省水利厅提供的资料显示,甘肃省水资源人均占有量1077立方米,仅为全国人均的1/3,是世界人均水平的近1/8,已经接近国际重度缺水界限。西部干旱缺水导致生态环境恶劣,那里光秃秃的黄土上寸草不生,土地龟裂,河流干涸,“三年两头旱,十种九不收”是那里农业生产的真实写照。雨水集蓄工程即通过一定的人为措施将自然界中的雨水收集起来加以利用的工程,该工程作为改善西部缺水地区农民生活状况和生态环境的有效手段,已取得很大成效。本文包括绪论、正文七章、结论三个部分。首先,通过对雨水集蓄工程进行介绍,引出由于工程资金的问题而导致的一些问题的存在。然后,对雨水集蓄工程中的资金问题展开分析,正确使用和管理工程资金是保障工程建设的重要环节。建设雨水集蓄工程的资金主要来自政府的财政拨款和慈善组织的捐赠,这两种形式的资金在法律性质上是存在差别的,本文通过对两种资金法律性质的分析,指出两种资金之间法律性质的差别以及权利义务上的不同,进而说明应当如何运用这两种资金,以求建立一种资金监督管理模式,来保障雨水集蓄工程的施工质量,使该工程得到更好地建设。其次,提出了农业保险的措施,希望通过工程资金对农业保险的投入,使工程的危险系数降到最低,最后,提出如何通过建立一种雨水集蓄工程资金的监督管理模式来保障工程的顺利进行。
[Abstract]:In the northwest part of China, it mainly includes the Inner Mongolia Plateau, the Loess Plateau, the western margin of Sichuan Basin to the west of Yungui Plateau. Due to natural and historical reasons, this part of the region is extremely short of water. According to the data provided by the Gansu Provincial Water Resources Department, the per capita water resources per capita in Gansu Province is 1077 cubic meters. Only one third of the country's per capita, or nearly a quarter of the world's per capita level, is close to the international limit for severe water shortages. The drought and water shortage in the west has led to the abominable ecological environment, where there is no grass on the bare loess, the land is cracked, the rivers are dried up, and "three years of drought, ten kinds and nine crops" is a true portrayal of the agricultural production there. Rain Water's gathering and storage project is a project that collects and uses Rain Water in nature through certain human measures. As an effective means to improve the living conditions and ecological environment of farmers in the western region of water shortage, Rain Water has achieved great results. This paper includes three parts: introduction, seven chapters and conclusion. First of all, by introducing Rain Water's accumulation project, some problems caused by project funds are introduced. Then, the paper analyzes the fund problem in Rain Water's collecting and storing project, and correctly uses and manages the project fund is the important link to guarantee the project construction. The funds for the construction of Rain Water's storage project mainly come from the government's financial allocation and charitable organization's donation. There are differences in the legal nature of these two forms of funds. This paper analyzes the legal nature of the two kinds of funds. This paper points out the differences of legal nature and rights and obligations between the two kinds of funds, and further explains how to use the two funds in order to establish a fund supervision and management model to guarantee the construction quality of Rain Water's collective storage project. The project was better built. Secondly, the paper puts forward the measures of agricultural insurance, hoping to reduce the risk coefficient of the project to the minimum through the investment of the project funds to the agricultural insurance. Finally, This paper puts forward how to establish a supervision and management mode of Rain Water collecting project funds to ensure the smooth progress of the project.
