国家公园利益冲突的法律协调机制研究

【摘要】：党的十八届三中全会从中央层面提出要把建立国家公园体制作为生态文明制度建设的重要举措,为我国国家公园建设指明了方向。国家公园作为应对环境问题的一种路径创新,被认为是一种能够兼顾生态效益、经济效益和社会效益的行之有效的保护地管理模式,它能够在确保生态环境不被破坏的前提下,积极发挥保护地的经济价值,带动保护地所在地区经济的发展,从而有效解决保护地建设中保护与开发的矛盾。我国的国家公园试点建设实践暴露出一些问题,如重开发而轻保护、地役权冲突等。利益冲突是导致这些问题的深层原因,它反映了相关利益主体在国家公园建设中利益的失衡,必须予以理顺和化解,才能保障国家公园的顺利推进。本文通过对国家公园建设中的核心利益主体以及各主体间的利益冲突进行梳理分析,以期构建协调和平衡各方的利益的法律机制。本文共分为四部分:第一部分是导论,介绍了本文的研究背景、研究意义、研究的主要内容以及研究思路与方法;第二部分是我国国家公园的建设实践,简要介绍了国家公园的概述、我国国家公园的试点运行情况以及暴露的问题;第三部分介绍了国家公园的核心利益相关者及彼此的利益冲突;第四部分是利益冲突的法律协调机制研究,从利益表达机制、利益分配机制、利益补偿机制、利益保障机制和利益冲突的解决机制五方面提出了解决利益冲突的思路。
[Abstract]:The third Plenary session of the 18th CPC Central Committee proposed from the central level that the establishment of the national park system should be regarded as an important measure in the construction of the ecological civilization system, and pointed out the direction for the construction of the national park in our country. As a path innovation to deal with environmental problems, national parks are considered to be an effective protective land management model which can take into account ecological benefits, economic benefits and social benefits, and it can ensure that the ecological environment is not destroyed. We should give full play to the economic value of the protected land, promote the economic development of the protected area, and effectively solve the contradiction between protection and development in the construction of protected land. The practice of national park pilot construction in our country exposed some problems, such as emphasizing development rather than protecting, easement conflict and so on. The conflict of interest is the deep cause of these problems, which reflects the imbalance of the interests of the relevant stakeholders in the construction of the national park, which must be straightened out and resolved in order to ensure the smooth advancement of the national park. This paper analyzes the main body of the core interests and the conflicts of interest among the main bodies in the construction of national parks in order to construct a legal mechanism to coordinate and balance the interests of all parties. This paper is divided into four parts: the first part is an introduction, introduced the research background, research significance, the main contents of the study, as well as research ideas and methods; The second part is the construction practice of national parks in China. It briefly introduces the outline of national parks, the operation of national parks in China and the exposed problems. The third part introduces the key stakeholders of national parks and their conflicts of interest. The fourth part is the study of the legal coordination mechanism of the conflict of interest. It puts forward the idea of solving the conflict of interest from five aspects: the mechanism of interest expression, the mechanism of interest distribution, the mechanism of interest compensation, the mechanism of interest protection and the mechanism of resolving the conflict of interest.
