浙江省湿地保护立法研究

【摘要】：湿地作为保障国家、全球生态安全和经济可持续发展的重要资源,具有很高的经济价值,但是其更重要的生态价值却并不为人知。随着全球人口的急剧增加,工农业的快速发展,人类对湿地的不合理开发利用加剧,导致湿地整体生态功能和生物多样性的急剧下降。在地震和干旱等自然灾害的接踵而至,使得各国政府和人民的生命财产受到威胁。同时经济总量在全国名列前茅的浙江省,省内的各类湿地也正经历着生态环境的污染破坏和资源的过度消耗。由于现有的法律规范已不足以保护这些正在饱受欺凌的湿地,基于此本文首次提出了浙江省湿地保护的立法框架的构建,分别从立法理念,管理体制和法律制度等方面来探讨。本文以浙江省的湿地保护法律关系为研究对象,从湿地概念界定出发,梳理了国内外湿地的含义进而提出我省湿地应该采取的定义。在浙江省湿地资源保护现状的基础上,运用比较的方法,引出浙江省湿地保护的立法现状和国内外湿地保护立法的理念,管理制度以及法律制度的比较,总结了其对浙江省湿地保护立法的启示。指出现行法律规范已不能满足浙江省湿地资源保护的现实需要,存在空白与缺陷。最后提出对浙江省湿地保护立法的设想,浙江省应借鉴国外湿地资源保护先进的立法经验,参照其他省市的地方立法,运用分类分析的方法把国外一些发达国家的立法理念,管理制度以及法律制度引进来。本文旨在为浙江省湿地保护专门法律建立和完善提供有益探索和建议。
[Abstract]:Wetland, as an important resource to ensure national, global ecological security and sustainable economic development, has high economic value, but its more important ecological value is not known. With the rapid increase of the global population and the rapid development of industry and agriculture, the unreasonable exploitation and utilization of wetlands are aggravated, which leads to a sharp decline in the overall ecological function and biodiversity of wetlands. Natural disasters, such as earthquakes and droughts, threaten the lives and property of governments and peoples. At the same time, all kinds of wetlands in Zhejiang Province, where the economy is among the highest in China, are also experiencing pollution damage and excessive consumption of resources. Because the existing laws and regulations are not enough to protect these swayed wetlands, this paper first puts forward the construction of legislative framework for wetland protection in Zhejiang Province, respectively from the aspects of legislative concept, management system and legal system. This paper takes the legal relationship of wetland protection in Zhejiang Province as the research object, starting from the definition of wetland concept, combing the meaning of wetland at home and abroad and putting forward the definition of wetland in our province. On the basis of the present situation of wetland resources protection in Zhejiang Province, the legislative status of wetland protection in Zhejiang Province and the concept, management system and legal system of wetland protection at home and abroad are compared with each other by means of comparative method. The enlightenment to the legislation of wetland protection in Zhejiang province is summarized. It is pointed out that the current legal norms can no longer meet the practical needs of wetland resources protection in Zhejiang Province, and there are gaps and defects. Finally, the author puts forward some tentative ideas on wetland protection legislation in Zhejiang province. Zhejiang should draw lessons from the advanced legislative experience of foreign wetland resources protection, refer to the local legislation of other provinces and cities, and apply the method of classified analysis to the legislative ideas of some developed countries abroad. The management system and the legal system were introduced. The purpose of this paper is to provide beneficial exploration and suggestions for the establishment and improvement of special laws on wetland protection in Zhejiang Province.
