我国商业银行节能减排授信法律问题研究

【摘要】:哥本哈根会议之后,低碳经济被国际社会所普遍倡导。这种新型经济符合我国的国家利益,有利于实现可持续发展战略和建设“资源节约型和环境友好型”社会。在推进低碳经济过程中,国家应积极完善相关立法,特别是要依法加强对宏观经济的调控与规范,规范低碳绿色的生产方式和生活模式,建立科学的节能减排法律体系及法治保障机制。 商业银行节能减排授信法律问题的研究是建立节能减排法律体系的重要课题。随着环境危机日益深重,我国环境法现有规定在调控企业污染行为方面作用越来越显现出其局限性。随着企业社会责任、可持续发展理念以及低碳经济的勃兴,金融机构对环境的社会责任日益受到国际社会的关注。我国政府在推行环境保护的经济政策中也意识到,要在源头上调控企业的环境行为,离不开金融机构特别是银行的参与,银行对环境问题的态度至关重要。 商业银行在为社会众公提供服务的同时,又经营着信用、传导着政策、调配着资源,是金融发展的重要力量和现代经济的核心。银行的主要业务是吸收社会存款,发放贷款和进行投资,对金融资源的调配引导着社会宏观经济的发展走向。银行作为贷款人,其贷款决策中对环境的考虑将决定金融资源的流向和产业结构的调整方向,故银行的贷款决策对环境、经济与社会的可持续发展起着重要作用。同时,银行通过开发出绿色金融产品扩大利润,也能够为其自身带来商机。与国外相对成熟的立法相比,我国节能减排授信经历了政策的成熟阶段之后,其法律化的要求逐渐显现。因此,对商业银行节能减排授信法律问题的研究正当其时。 本文共分为七个部分对我国推行“绿色信贷”政策的节能减排授信之法律问题进行论述:前言部分简述文章内容;第一章首先概述节能减排授信的涵义及其法治实践,其次通过域际和国际法治实践比较得出我国节能减排授信中现存的法律问题;接下来四部分分别针对第一章提出的问题给出法律对策,以节能减排授信中的利益关系为逻辑基础,对保障节能减排授信实施的各项机制进行法学思考,提出建立和完善各项机制的建议;结语对全文进行总结并提出研究的创新点和局限性。
[Abstract]:After Copenhagen, the low-carbon economy is generally advocated by the international community. This new economy conforms to the national interests of our country and is conducive to the realization of the strategy of sustainable development and the construction of a "resource-saving and environment-friendly" society. In the process of promoting a low-carbon economy, the state should actively improve the relevant legislation, especially to strengthen the regulation and regulation of the macro-economy according to law, and standardize the low-carbon green production mode and living mode. Establish a scientific energy conservation and emission reduction legal system and legal protection mechanism. The research on the legal issues of energy saving and emission reduction credit in commercial banks is an important issue in the establishment of energy saving and emission reduction legal system. As the environmental crisis becomes more and more serious, the existing regulations of environmental law in our country play a more and more important role in regulating the pollution behavior of enterprises. With the development of corporate social responsibility, sustainable development and low-carbon economy, the social responsibility of financial institutions to the environment has been paid more and more attention by the international community. In carrying out the economic policy of environmental protection, our government also realized that to regulate the environmental behavior of enterprises at the source, the participation of financial institutions, especially banks, is indispensable, and the attitude of banks to environmental problems is very important. While providing services for the public, commercial banks operate credit, conduct policies and allocate resources, which is the important force of financial development and the core of modern economy. The main business of banks is to absorb social deposits, issue loans and invest. The allocation of financial resources guides the development of social macro-economy. As the lender, the consideration of the environment in the loan decision of the bank will determine the direction of the financial resources and the adjustment of the industrial structure, so the loan decision of the bank plays an important role in the sustainable development of the environment, economy and society. At the same time, banks through the development of green financial products to expand profits, but also for its own business opportunities. Compared with the relatively mature legislation in foreign countries, the requirement of legalization of energy saving and emission reduction credit in China has gradually appeared after the mature stage of policy. Therefore, it is time to study the legal issues of energy saving and emission reduction credit in commercial banks. This paper is divided into seven parts to discuss the legal issues of energy saving and emission reduction credit in China's implementation of "green credit" policy: the preface is a brief introduction of the content of the article; The first chapter summarizes the meaning of energy saving and emission reduction credit and its legal practice. Secondly, through the comparison of international and regional legal practice, the existing legal problems in energy saving and emission reduction credit in China are obtained. The next four parts give the legal countermeasures to the problems raised in the first chapter, taking the benefit relationship in the credit of energy saving and emission reduction as the logical basis, and the legal thinking on the mechanism to guarantee the implementation of the credit for energy saving and emission reduction. To put forward proposals to establish and improve the mechanisms; The conclusion summarizes the full text and puts forward the innovation and limitation of the research.
