矿业权的出让取得研究

【摘要】：随着经济的发展,一个国家矿产资源的储备和供给水平,对于一个国家的发展意义重大,成为国家富强的关键,但是规范矿业活动的我国矿业权法律制度尤其是出让制度还很不完善,在矿业活动的实践中出现了各种问题。比如环境污染、国有资产流失、矿业权人的利益常常受到侵犯等,这些问题都有待于法律给予解决。 本文内容主要包括矿业权的概念、矿业权的属性、矿业权出让原则、出让的规则、程序和矿业权登记这几个重要方面。论文共分四部分试图对矿业权出让取得进行系统地探讨。 第一部分主要在介绍矿业权概念的基础上,得出矿业权是财产权、是有公法因素的物权、用益物权。探讨了矿业权的法律属性对矿业权出让取得的影响,探讨了外国矿业权出让与登记的立法实践对我们的启示。 第二部分主要在介绍矿业权出让概念的基础上,阐述矿业权出让的三个原则,并分析了要坚持这三个原则的原因。 第三部分主要在介绍了矿业权出让的主体、条件、方式和程序后,对存在的问题进行了阐述。 第四部分在介绍矿业权登记的意义、登记的范围、登记的程序、登记的效力的基础上,指出我国矿业权登记制度的不足,并探讨了完善的建议。
[Abstract]:With the development of economy, the reserve and supply level of a country's mineral resources is of great significance to the development of a country. However, the legal system of mining rights in China, especially the transfer system, which regulates mining activities, is still far from perfect, and various problems have appeared in the practice of mining activities. For example, environmental pollution, the loss of state-owned assets, the interests of mining owners are often infringed, these problems need to be resolved by law. This paper mainly includes the concept of mining rights, the attributes of mining rights, mining rights transfer principles, transfer rules, procedures and mining rights registration of these important aspects. The thesis is divided into four parts, which try to make a systematic study on the transfer of mining rights. In the first part, on the basis of introducing the concept of mining right, it is concluded that mining right is property right, public law factor real right, usufruct right. This paper probes into the influence of the legal attributes of mining rights on the transfer of mining rights, and probes into the enlightenment to us from the legislative practice of foreign mining rights transfer and registration. The second part mainly introduces the concept of mining right transfer, expounds the three principles of mining right transfer, and analyzes the reasons for adhering to these three principles. The third part mainly introduces the main body, condition, method and procedure of mining right transfer. On the basis of introducing the significance, scope, procedure and effectiveness of mining right registration, the fourth part points out the deficiency of mining right registration system in our country, and probes into some perfect suggestions.
