矿业权流转方式法律制度研究

【摘要】：2007年《物权法》出台,其中明确将探矿权和采矿权作为一项民事财产权利收入物权的范畴,在一定程度上推动了矿业权流转秩序的活跃和有序。但是随后2009年山西省率先掀起的矿产资源整合运动,又一次将社会各界的视线拉回到国家矿产业中来,不过这一次,却是大大压缩了矿业权市场的范围。现在,这两条相背离的发展道路被一同展现到社会面前,都希望能够完善矿业权市场,提高矿产业效率,减少资源浪费以及维护矿业安全和可持续发展。那么,矿业权究竟应该何去何从?面对这个问题,本文将首先以经济学原理和我国矿产业领域近代发展的现实为基础,提出矿业权市场需要通过完善流转方式来进一步深化市场化改革的思路,然后以矿业权背后的价值基础为依托,以国外矿业权发展的经验为借鉴,希望进一步对我国现行矿业权流转法律制度进行分析和论证。结合目前国内学界的学术研究成果,可以发现,矿业权法律制度的理论方面,已经形成了丰富的研究成果,为矿业权流转法律制度的研究奠定了坚实的法理基础,同时,目前也已经有部分学者开始对矿业权流转法律制度进行研究,并且极具启发性。所以,本文希望在借鉴前人研究的基础之上,选择矿业权流转方式这一切入点,通过对矿业权流转方式的法律规范的分析,结合矿业权流转的现实案例,以矿业权的出让、转让、出租、抵押、承包、继承这六种流转方式为对象,来对矿业权流转方式法律制度进行补充和完善。
[Abstract]:In 2007, the property Law was issued, in which the exploration right and mining right were explicitly regarded as a category of civil property right income real right, which to some extent promoted the active and orderly order of the circulation order of mining rights. But then in 2009 Shanxi Province took the lead in the mineral resources integration movement, once again drawing the attention of all walks of life back to the national mining industry, but this time, it has greatly compressed the scope of mining rights market. Now, these two development paths which deviate from each other are presented to the society together, and both hope to perfect the market of mining rights, improve the efficiency of mining industry, reduce the waste of resources and maintain the safety and sustainable development of mining industry. So, where should mining rights go? In the face of this problem, this paper will, first of all, base on the principles of economics and the reality of modern development in the field of mineral industry in China, and put forward the idea that the market of mining rights needs to further deepen the market-oriented reform by perfecting the circulation mode. Then, based on the value foundation of mining right and the experience of foreign mining right development, the author hopes to further analyze and demonstrate the current legal system of mining right circulation in our country. Combined with the current academic research results in China, we can find that the theoretical aspects of the legal system of mining rights have already formed rich research results, which has laid a solid legal basis for the study of the legal system of mining rights circulation, at the same time, At present, some scholars have begun to study the legal system of mining right transfer, and very enlightening. Therefore, this paper hopes to choose the mining right transfer mode on the basis of previous studies, through the analysis of the legal norms of mining right transfer mode, combined with the actual case of mining right transfer, the transfer of mining rights, Transfer, lease, mortgage, contract and inheritance of these six circulation methods as the object, to supplement and improve the legal system of mining right transfer.
