德国与英国可再生能源法之比较及对我国的启示

【摘要】：德国和英国的可再生能源发展都处于世界先进水平,德国在可再生能源发电、供热和交通用能三大领域制定了专门的法律,英国则以《电力法》、《可再生能源义务法令》和《可再生交通燃料义务法令》为主体,建立了独具特色的可再生能源义务制度。德国与英国可再生能源法在立法理念、立法目的、法律位阶、法律体系和法律规范等方面既有相似之处又各具特点。可再生能源立法和制度运行的差异是德英两国可再生能源发展状况差异的重要原因,对我国发展可再生能源等新能源具有重要的参考价值。本文基于对德国和英国可再生能源立法、法律规定和实施绩效的比较研究,提出完善我国可再生能源立法和法律制度的对策。
[Abstract]:The development of renewable energy in Germany and the United Kingdom is at the advanced level in the world. Germany has enacted special laws in the fields of renewable energy generation, heating and transportation energy, while the United Kingdom has adopted the electricity Act. The Renewable Energy obligations Act and the Renewable Transportation fuel obligations Act have set up a unique renewable energy obligation system. German and British renewable energy laws have similarities and characteristics in terms of legislative idea, legislative purpose, legal rank, legal system and legal norms. The difference in legislation and system operation of renewable energy is an important reason for the difference in the development of renewable energy between Germany and Britain. It is of great reference value for the development of renewable energy and other new energy sources in China. Based on a comparative study of the legislation, regulation and implementation of renewable energy in Germany and Britain, this paper puts forward some countermeasures to perfect the legislation and legal system of renewable energy in China.
