我国能源节约法律体系构建的对策研究

【摘要】：十七大提出建设生态文明社会,大力推进节约,建立节能型工业、节能型社会,能源安全问题也日益成为国际关注的敏感问题,但是,当今的社会能源问题日渐突出,如何合理节约利用能源、保持能源的可持续发展,越来越受到各国政府和研究机构的普遍关注。而通过立法,以法律法规的形式调整人们在能源节约活动中的行为,则是解决这一问题的一个根本途径。本文针对我国能源节约法律体系不完善的现实,依据立法学的一般理论,参照相关的资源法、环境法,并借鉴国内外已有的研究成果,试图为推动能源节约立法做一些有益的探索,从而推动我国可持续发展的进程。 本文一共由五章组成,分别是： 第一章是：“绪论”,论述了本文选题的目的和意义,文献综述以及本文的写作方法和创新点。 第二章是：列举我国节能现状,以及节能立法现状。 第三章是：从效力等级、立法内容的完整性和可操作性三个方面,对包括《宪法》、《节约能源法》、《可再生能源法》等法律法规在内的我国现行节能立法展开系统分析,探讨其中存在的缺陷和不足； 第四章是：列举美国、日本、欧盟的节能立法状况和能源节约的政策,分析国际节能立法的趋势,以及其能源节约立法对我国相关立法的启示。 第五章是：有针对性地归纳出完善我国节能立法的政府主导原则、经济激励原则、鼓励技术创新原则、节能高效原则、义务本位原则等重要原则,并依据我国现行节能立法和国外有益经验,建议制定能源基本法、制定和修改节能单行法,整合现有能源单行法以形成节能单行法体系,以及创设和完善消费者节能激励、强制性能效标准和节能自愿性协议、可再生能源配给制度等重要节能法律制度。 第六章是：对本文的结论和创新点进行总结。 本文通过能源节约立法体系应当是一个稳定的、具有实际内容和效力的,以基本法与专项立法相结合,以全国人大立法和国务院行政法规为主、部门规章和地方性法规为辅的法律体系,它是以能源节约基本法为核心,专项法完备的,由多层次、门类齐全的能源节约法律法规组成的有机联系的统一整体。
[Abstract]:The 17th National Congress of the Communist Party of China (CPC) put forward that building an ecological civilized society, vigorously promoting conservation, establishing energy-saving industry, energy-saving society, and energy security have increasingly become sensitive issues of international attention. however, the problem of social energy is becoming more and more prominent. How to rationally save and use energy and maintain the sustainable development of energy has been paid more and more attention by governments and research institutions. It is a fundamental way to solve this problem to adjust people's behavior in energy conservation activities in the form of laws and regulations through legislation. In view of the imperfect legal system of energy conservation in our country, according to the general theory of legislation, referring to the relevant resource law, environmental law, and drawing lessons from the existing research results at home and abroad, this paper tries to make some beneficial explorations to promote the legislation of energy conservation, so as to promote the process of sustainable development in our country. This paper consists of five chapters, which are as follows: the first chapter is "introduction", which discusses the purpose and significance of this topic, literature review, as well as the writing methods and innovations of this paper. The second chapter is: enumerates the present situation of energy saving in our country, as well as the present situation of energy saving legislation. The third chapter is: from the effective level, the integrity and maneuverability of the legislative content, including the Constitution, the Energy Saving Law, the Renewable Energy Law and other laws and regulations, this paper makes a systematic analysis of the current energy conservation legislation in China, and discusses the defects and shortcomings. The fourth chapter is to enumerate the status of energy conservation legislation and energy conservation policies of the United States, Japan and the European Union, and analyze the trend of international energy conservation legislation, as well as the enlightenment of its energy conservation legislation to the relevant legislation of our country. The fifth chapter summarizes the important principles such as government leading principle, economic incentive principle, encouraging technological innovation principle, energy saving efficiency principle, obligation standard principle and so on. According to the current energy saving legislation of our country and the beneficial experience of foreign countries, it is suggested that the energy basic law should be formulated, the energy saving single line law should be formulated and amended, and the existing energy single line law should be integrated to form the energy saving one line law system. And the creation and improvement of consumer energy conservation incentives, mandatory performance efficiency standards and voluntary agreements for energy conservation, renewable energy rationing system and other important energy conservation legal systems. The sixth chapter is: the conclusion and innovation of this paper are summarized. In this paper, the legislative system of energy conservation should be stable, with practical content and effect, combined with the basic law and special legislation, dominated by the legislation of the National people's Congress and the administrative regulations of the State Council, supplemented by departmental regulations and local laws and regulations. It is based on the basic law of energy conservation, the special law is complete, and the special law is multi-level. A unified whole of organic links composed of complete categories of energy conservation laws and regulations.
