浅议草原法中规定的行政处分

【摘要】：我国草原分布范围极广,各地的经济发展水平差异较大,并且在草原管理中需要重点解决的问题也不太一样。我国草原法律体系中对行政处分的规定纷繁复杂,法律、行政法规、部门规章与地方性法规、地方政府规章以及不同区域的地方性法规、地方政府规章之间对行政处分的规定不尽相同,例如应当对其进行行政处分的行政违法行为种类以及受处分人的范围等。通过对草原法中规定的行政处分的分析,认为严格和准确适用草原法的行政处分手段,是新时期草原法律保护最基本的措施。
[Abstract]:The distribution of grassland in China is very wide, and the level of economic development varies greatly from place to place, and the problems that need to be solved in grassland management are not the same. In the grassland legal system of our country, the provisions on administrative sanctions are numerous and complex, such as laws, administrative regulations, departmental rules and regulations with local laws and regulations, local government regulations and local laws and regulations in different regions, and the provisions on administrative sanctions are not the same among local government rules, such as the types of administrative illegal acts that should be imposed on them and the scope of the person to be punished, and so on. Through the analysis of the administrative sanctions stipulated in the grassland law, it is considered that the strict and accurate application of the administrative punishment means of the grassland law is the most basic measure for the protection of grassland law in the new period.
