《反家庭暴力法》中人身安全保护令制度研究

【摘要】：家庭暴力作为全世界的顽疾,世界各国与之奋战了多年。我国在受"家暴乃家务事"的封建落后思想的桎梏后,在近些年来也猛然觉醒,与之抗争。2016年,《反家庭暴力法》的出台,标志着我国家庭暴力的防治工作迈上了一个新的台阶。在《反家庭暴力法》中,人身安全保护令制度的设立,将是我国应对家庭暴力的有效手段。但由于人身安全保护令制度在我国尚属于新兴产物,相应的立法显得过于简陋。在制度设定的多个环节,均未能行之有效地发挥人身安全保护令的作用,在保护受害者权益方面尤有巨大的提升空间。笔者认为,申请主体范围方面、举证责任分配方面、送达执行方面都存在制度的设计漏洞,而紧急安全保护令的缺失、惩戒措施的匮乏、处遇计划的空白都将使得人身安全保护令制度不够圆满,有虎头蛇尾之嫌。如何能够在未来的发展过程中,将人身安全保护令制度不断完善,使之更好地发挥对家庭暴力受害者的保护作用,将是我们未来《反家庭暴力法》修改的重点工作。国外在人身安全保护令制度方面有着多年的经验探索,各个国家形成了一套独具特色的操作模式,本文将借鉴国外的立法经验,结合我国过去人身安全保护裁定的试点成效和人身安全保护令的施行效果,进行分析研究。在此基础之上,笔者大胆提出明确申请人主体资格、设立紧急安全保护令制度、建立人身安全保护令的绿色通道、完善人身安全保护令的执行所、明确证据要求和举证责任、加大惩戒措施、建立多元联动机制、细化执行内容、构建人身安全保护令特殊的执行与送达程序、提高宣传力度等十点修改建议,试图构建具有整体性的人身安全保护令体系,为制度完善指明未来的发展方向。
[Abstract]:Domestic violence, as a persistent disease in the world, has been fought with all over the world for many years. After being shackled by the feudal and backward idea that "domestic violence is a domestic affair", our country has also awakened abruptly in recent years. On 2016, the promulgation of the "Law against domestic violence" marked a new step forward in the prevention and treatment of domestic violence in China. In the "Anti-domestic violence Law", the establishment of the system of personal security protection orders, It will be an effective means to deal with domestic violence in our country. However, as the system of personal security order is still a new product in our country, the corresponding legislation is too simple. There is a great room for improvement in protecting the rights and interests of the victims. The author believes that the scope of the application, the distribution of the burden of proof, There are loopholes in the design of the system for service implementation, and the absence of emergency security protection orders, the lack of disciplinary measures, and the lack of planning will make the system of personal security orders unsatisfactory. How can the system of personal security protection be perfected in the future, so that it can play a better role in protecting victims of domestic violence? This will be the focus of our future revision of the Anti-domestic violence Law. Foreign countries have many years of experience exploring the system of personal protection orders, and various countries have formed a unique set of operating modes. This article will draw lessons from the foreign legislative experience, combine our country's past personal security ruling pilot effect and the effect of the personal security protection order, carry on the analysis and research. On this basis, the author boldly proposes to define the applicant's subject qualification. Establish emergency security protection order system, establish the green passage of personal security protection order, perfect the enforcement of personal security protection order, clarify the evidence requirement and burden of proof, increase disciplinary measures, establish multiple linkage mechanism, and refine the implementation content, In order to set up the special execution and service procedure of the personal security protection order and to improve the propaganda, the author tries to construct the whole personal security protection order system and point out the future development direction for the perfection of the system.
