论离婚时按揭房屋及增值部分的归属与分割

【摘要】： 在当今社会,消费观念不断转变,按揭购房已成为普通百姓解决住房问题的一种主流方式。这类房屋在离婚诉讼中的归属与分割问题因为牵涉物权法、房产法、婚姻法等诸多法律规定,就不可避免地成为了离婚纠纷中的热点、难点。但是这一热点、难点目前面临立法的粗疏与理念的冲突,使得对于按揭房屋在离婚纠纷中的处理已逐渐成为了困扰司法实践的难题。因此,本文对于涉及按揭房屋在离婚纠纷中的处理的法律问题的研究具有重要的现实价值。 目前我国夫妻财产制采用的是法定与约定相结合的的夫妻财产制度,但除了采用列举方式外,婚姻法对夫妻共同财产并没有规定明确的认定标准。考虑到约定财产制下按揭房屋的定性和处理相对比较容易,且司法实践中的问题绝大多数发生在法定财产制场合,故本文探讨仅限于法定财产制背景下,对夫妻一方按揭购买房屋在离婚诉讼中的归属与分割问题从法律角度做初步探讨,以期对完善我国夫妻财产分割制度有所助益。 本文除引言、结语外,共有四章:第一章是问题的提出,把法律法规及司法解释中对离婚财产分割时,按揭房屋及增值部分的归属及分割的相关规定做以梳理,将司法实践中这一问题的复杂性加以展现,从而厘清本选题的主要内容及重要意义;第二章主要对离婚时按揭房屋的归属与分割进行讨论,首先对按揭房屋这一概念进行界定,然后根据按揭房屋的不同情形,将按揭房屋划分为不同类型分别加以探讨;第三章在对按揭房屋增值部分的属性进行认定的基础上,探讨按揭房屋增值部分的归属及分割;第四章就按揭房屋及增值部分在离婚财产分割中应考虑的一般原则及特殊原则加以说明。
[Abstract]:In today's society, the concept of consumption has been changing, mortgage purchase has become a common people to solve the housing problem of a mainstream way.The ownership and division of this kind of house in the divorce proceedings has inevitably become a hot point and difficulty in divorce disputes because it involves many legal provisions such as property law, real estate law, marriage law and so on.However, the hot spot and the difficult point are facing the conflict between the legislation and the idea, which makes the settlement of the mortgage house in the divorce dispute gradually become a difficult problem puzzling the judicial practice.Therefore, this paper has important practical value for the study of legal issues concerning the settlement of mortgage housing in divorce disputes.At present, the husband and wife property system in our country adopts the husband and wife property system which combines the law with the agreement, but in addition to adopting the enumeration method, the marriage law has not stipulated the definite standard to the husband and wife joint property.Considering that it is relatively easy to define and deal with the mortgage house under the agreed property system, and that most of the problems in judicial practice occur in the context of the legal property system, the discussion in this paper is limited to the background of the legal property system.This paper makes a preliminary discussion on the ownership and division of the house purchased by one spouse mortgage in divorce proceedings from the angle of law in order to improve the division system of husband and wife property in our country.In addition to the introduction and conclusion, there are four chapters in this paper: the first chapter is the introduction of the question, the laws and regulations and judicial interpretation of divorce property division, mortgage housing and value-added parts of the ownership and division of the relevant provisions to sort out.In order to clarify the main content and significance of this topic, the second chapter mainly discusses the ownership and division of mortgage house in divorce, and defines the concept of mortgage house.Then according to the different situation of the mortgage housing, the paper divides the mortgage housing into different types, and discusses the attribution and division of the value-added part of the mortgage housing on the basis of the identification of the attributes of the value-added part of the mortgage housing.Chapter 4 explains the general principles and special principles which should be taken into account in the division of divorce property.
