【摘要】：家庭是一国社会最基本的组成团体,如果说社会是一张网,那么家庭就是组成这张网的一个节。家庭在社会中扮演者必不可少、举足轻重的角色。对于每个公民来讲,谈及家庭,给人的感觉应该是归属感,是安全感,是我们在为生活奔波劳苦之后所想要栖息的地方。他应该是我们的身体得以放松的一个居所,一个精神上得以休息的避风港。但是理想与现实总会有一定的差距,生活总是给予我们一定的刺痛,让我们看清她本来的面目,而家庭暴力,便是存在于这个社会的一根刺。严格来讲,家庭暴力并不是近期甚至近几十年来出现的一种社会现象,这种社会恶习由来已久,甚至已经有了几千年的历史。它顽固的贯穿了我国从古代直到现代的一个历史脉络,将根扎的根深蒂固,以至于现今我们难以将其一次性拔除。无独有偶,家庭暴力并仅仅存在于我国,它已经成为了一种世界性的恶习,几乎每一个国家都有部分公民遭受着家庭暴力的侵害。家庭暴力不仅仅是单纯的暴力性殴打,它花样百出,既包括身体上的摧残,也包括受精神上的折磨。受暴者其基本人权被牢牢的束缚在家庭暴力的魔爪之下,没有公平可言,没有平等可言。别国我们暂且不提,令人可悲的是,我国虽然泱泱大国,精神文化沉淀了几千年,却在反对家庭暴力方面做得少之甚少。反而从我国尚未立法时期,就已经出现了男女不平等,男尊女卑,夫为妻纲的观念,这种观念一直持续了几千年。更加令人可悲的是,到了现代社会,家庭暴力非但没有遭人唾弃,让人反抗,反而变本加厉。古代时期,家庭暴力是指存在于家庭之中的夫妻之间或者家长与子女之间的一种暴力,而现在社会,家庭暴力已经蔓延到了非家庭之间,如情侣之间,同居者之间。更有甚者,子女殴打老人的家庭暴力也是存在的。不得不说我国在反家庭暴力方面所做的一切让人心寒。统治者的冷漠,道德的无视,使得我国整个社会对家庭暴力的约束力度过于松泛,让家庭暴力如细菌一般不断蔓延。因此,本人围绕家庭暴力行为,从家庭暴力的概况、国内外对家庭暴力的规制、家庭暴力法的评析以及家庭暴力法的完善建议等方面对家庭暴力进行了一定的浅析。本文共包括四章内容,具体内容如下:第一章主要围绕家庭暴力的基本情况做了一定概述。首先对家庭暴力这一概念进行界定,对其本质特性进行详细的分析。其次,阐述家庭暴力的主体的特定性、行为的隐蔽性、结果的严重性、大众的放纵性等特点,进而分析家庭暴力的不利影响,即不仅侵害受暴者的健康权与自由权,还会影响到未成年人的身心健康、破坏家庭幸福甚至扰乱社会稳定。最后,从传统观念、立法现状以及社会大众态度等视角来分析家庭暴力如病毒般扩散的原因。第二章主要介绍了我国相关法律对家庭暴力的规定。我国虽然较晚的制定针对家庭暴力的专项立法,但是在此之前我国并非没有对家庭暴力行为进行法律约束。作者通过列举我国各部法律对家庭暴力的规定,进而分析我国关于家庭暴力立法的亮点与不足。第三章主要围绕国国外法律对家庭暴力行为的规定进行探讨评析。家庭暴力不仅仅是我国独立存在的社会问题,而是国际间一个普遍存在的社会乱象。本文从国际的角度来阐述美国、英国、加拿大等国家在立法方面对家庭暴力的约束,与我国公权力介入家庭暴力的形式作比较,进而对我国在家庭暴力的法律规制方面做出一个相对完善的评析。第四章主要介绍了我国反家庭暴力应该做出的完善。对于家庭暴力问题,我国自2016年以前,对家庭暴力行为进行制约的条文,都是零散的分布于各个法律法规当中,如《宪法》、《妇女权益保护法》、《刑法》、《民法》、《婚姻法》但是始终没有一项专门的法律来对其进行规制,以至于公民对家庭暴力的严重危害性认识不足,没有提起相当的重视,进而使家庭暴力行为不断出现。2016年3月1日起正式施行了《反家庭暴力法》,这是我国第一部专门围绕家庭暴力所制定的一部专项立法,这部法律成为我国反家庭暴力立法史上的一个里程碑,缓解了我国无关于家庭暴力专项立法的尴尬,对我国反家暴有着重要的意义。本文从立法角度、司法角度等方面,阐述了我国在反家庭暴力方面应该做出的完善。

Domestic violence is not only a simple violent assault, but also a kind of physical destruction, including mental torture. The basic human rights of the victims are firmly tied to the clunches of domestic violence. There is no equity and no equality. In other countries, we do not mention it. It is sad that, although our country has been a great country, the spiritual culture has been precipitated for thousands of years, little is done in the opposition to domestic violence. Instead, it has not been legislated in our country. The concept of equality between men and women, men and women, and the concept of husband as a wife have lasted for thousands of years. More sadly, in modern society, domestic violence is not only spit on, but has become stronger. In ancient times, family violence refers to the husband and wife or parents in the family. A kind of violence between children, and today's society, family violence has spread to non families, such as lovers, cohabitation. Even more, the family violence of the children beating the elderly is also existing. It is hard to say that everything we do in the field of anti domestic violence is cold. The restraint of domestic violence is too loose in the whole society, and the family violence, like bacteria, is generally spread. Therefore, I have done a certain amount of domestic violence around domestic violence, from domestic violence, domestic and foreign regulation of domestic violence, the assessment of domestic violence law and the improvement of domestic violence law. This article includes four chapters, and the specific contents are as follows: the first chapter is mainly about the basic situation of domestic violence. Firstly, the concept of domestic violence is defined, and its essential characteristics are analyzed in detail. Secondly, the specific nature of the main body of domestic violence, the concealment of the behavior, the severity of the results, and the serious results are discussed. The disadvantageous influence of domestic violence is analyzed, namely, the adverse effects of domestic violence are not only infringed on the right to health and freedom of the victims, but also on the physical and mental health of the minors, destroying family happiness and even disturbing social stability. Finally, the domestic violence, such as the virus, is analyzed from the traditional concept, the legislative situation and the social public attitude. The second chapter mainly introduces the regulation of domestic violence in our country. Although our country is late to formulate special legislation for domestic violence, our country does not have no legal restraint on domestic violence before it. The author analyses the regulations of domestic violence by the laws of our country, and then analyses me. The third chapter mainly discusses the provisions of domestic violence in the country and abroad. Domestic violence is not only a social problem in our country, but also a common social disorder in the world. This article expounds the United States, Britain, Canada and so on from the international perspective. The state's restriction on domestic violence in legislation is compared with the form of public power involved in domestic violence in China, and then a relatively perfect analysis is made to the legal regulation of domestic violence in China. The fourth chapter mainly introduces the complete good of our country's anti domestic violence. For domestic violence, China has since 2016 Before, the provisions that restrict domestic violence are scattered scattered in various laws and regulations, such as the constitution, the law of the protection of women's rights and interests, the criminal law, the civil law, and the marriage law, but there is no special law to regulate it, so that the citizens' serious harm to domestic violence is insufficient and has not been mentioned. When we attach great importance to the domestic violence, the law of anti domestic violence has been formally implemented from March 1st.2016. This is the first special legislation enacted in our country specially around domestic violence. This law has become a milestone in the history of domestic violence legislation in our country, which has relieved our country's lack of domestic violence. The embarrassment of the law is of great significance to the anti domestic violence in China. This article, from the legislative angle and the judicial angle, expounds the perfection that our country should make in the aspect of anti domestic violence.
