儿童遭受家庭暴力的法律救济研究

【摘要】：针对儿童的家庭暴力目前已受到社会各界的关注和重视。如何对遭受家庭暴力的儿童进行及时救济,给予他们全方位的保护,是亟待解决的问题。我国已经充分认识到保护遭受家暴侵害儿童的重要性和紧迫性,积极着手开展相关工作,《关于依法处理监护人侵害未成年人权益行为若干问题的意见》、《反家庭暴力法》等一系列法律法规相继出台,学界对此问题也开始探讨和研究。但是,这些立法并没有完全解决对受害儿童进行救助的问题,还存在相当的不足与空缺。因此,完善儿童遭受家庭暴力的法律救济仍旧需要更多的努力。本文除了引言与结论,共分为四个部分。第一部分是对儿童遭受家庭暴力的概述。笔者首先对儿童的概念作出界定,并分析了域外一些国家以及我国目前关于针对儿童的家庭暴力的定义,从而综合各方面因素,提出关于我国儿童遭受家庭暴力定义的想法。此外,分析了儿童遭受家暴的现状,期望能对当前我国儿童遭受家庭暴力的现状有整体的认识。第二部分论述了我国儿童遭受家庭暴力法律救济的立法现状及不足。笔者梳理、分析了我国当前有关救济家暴受害儿童的法律法规,并对这些规定中的不足给予概括总结,包括立法中没有体现儿童的特殊性、缺乏专门的保护机构、强制报告制度的可操作性不足、人身安全保护令的规定不够具体,以及撤销监护权的判后安置规定不完善。第三部分论述了域外关于儿童遭受家庭暴力的救济立法。笔者选取了美国、日本两个国家以及我国台湾地区,对其先进经验进行分析。例如美国的强制报告制度、日本的儿童商谈所、我国台湾地区的监督探望以及监护权撤销制度等,并对上述制度的共性作出概括。第四部分提出了完善我国儿童遭受家庭暴力法律救济的建议。在对上述章节进行分析的基础上,即基于我国儿童遭受家庭暴力的现状,救济中存在的问题,借鉴符合我国国情的经验,提出了相关改进建议,期望对救济家庭暴力受害儿童有所助益。
[Abstract]:At present, domestic violence against children has received attention from all walks of life. How to provide timely relief and comprehensive protection to children suffering from domestic violence is an urgent problem to be solved. My country is fully aware of the importance and urgency of protecting children victims of domestic violence, A series of laws and regulations, such as the opinions on dealing with the problems of guardian's infringing on minors' rights and interests according to law, and the Anti-domestic violence Law, have been issued one after another, and the academic circles have also begun to explore and study this issue. However, these legislation does not completely solve the problem of child victims, there are still considerable deficiencies and gaps. Therefore, more efforts are needed to improve legal remedies for children suffering from domestic violence. In addition to the introduction and conclusions, this paper is divided into four parts. The first part is an overview of children being subjected to domestic violence. At first, the author defines the concept of children, and analyzes the definition of domestic violence against children in some countries and our country at present, thus synthesizing all aspects of factors, puts forward the idea of definition of domestic violence against children in our country. In addition, this paper analyzes the current situation of children suffering from domestic violence, and expects to have an overall understanding of the current situation of children suffering from domestic violence in our country. The second part discusses the current situation and deficiency of domestic violence law relief for children in our country. The author combs and analyzes the current laws and regulations concerning the relief of child victims of domestic violence, and summarizes the shortcomings of these provisions, including the lack of special child protection institutions in the legislation. The mandatory reporting system is not operable enough, the regulations of personal security protection are not specific enough, and the provisions of post-sentence placement for revocation of custody are not perfect. The third part discusses the extraterritorial relief legislation on children suffering from domestic violence. The author selected two countries, the United States, Japan and Taiwan, to analyze their advanced experience. For example, the compulsory reporting system in the United States, the Children's bargaining Institute in Japan, the supervision and visitation system in Taiwan and the system of revocation of custody, etc., and generalize the commonalities of the above systems. The fourth part puts forward the suggestion of perfecting the legal remedy for children suffering from domestic violence in our country. Based on the analysis of the above chapters, that is, based on the current situation of children suffering from domestic violence in our country, the problems in relief, and the experience in accordance with the situation of our country, the paper puts forward some suggestions for improvement. It is expected to be helpful to the relief of child victims of domestic violence.
