论构建违反夫妻忠实义务损害赔偿制度

【摘要】：家庭关系的稳定关系到每个公民的切身利益,关系到子女的身心健康,更关系到社会的稳定与发展。夫妻关系则是其中的核心内容,而夫妻关系的底线是双方能够遵守夫妻忠实义务。而现实的情况是我国目前的婚外性行为比较泛滥,依靠道德的力量已经无法有效地制约这些行为,因此我建议,将违反夫妻忠实义务的五类行为,即重婚、有配偶的非法同居、通奸、卖淫嫖娼和包养行为,全部上升为由法律调整的行为。论文的第一章将介绍论文写作的背景、目的,讨论将传统的四类违反夫妻忠实义务上升为法律的必要性。同时,对于我国新出现的一类违反夫妻忠实义务的行为,包养也纳入法律调整的范围。第二章将专门介绍夫妻忠实义务的定义,介绍配偶权的定义与内容,以及将配偶权写入法律的必要性。第三章会讨论古今中外有关夫妻忠实义务的法律规定,,以及他们对于违反夫妻忠实义务的处罚,借鉴这些经验有利于我国法律制度的构建。第四章作者会对一些反对将夫妻忠实义务写入法律的观点进行分析,同时也会对现实中存在的个别问题进行分析,说明将其纳入法律是可行的、必要的。第五章将会对五类违反夫妻忠实义务的行为逐一提出具体的法律构建。
[Abstract]:The stability of family relationship relates to the vital interests of every citizen, to the physical and mental health of children, and to the stability and development of society. The relationship between husband and wife is the core of it, and the bottom line of the relationship is that both sides can abide by the obligation of husband and wife loyalty. But the reality is that the current behavior of extramarital sex in our country is more widespread, relying on the strength of morality can no longer effectively control these acts, so I suggest that the violation of the obligations of the husband and wife faithful to the five types of behavior, that is, bigamy, illegal cohabitation with a spouse, Adultery, prostitution and sheltering all rise to the act of legal adjustment. The first chapter will introduce the background and purpose of the thesis, and discuss the necessity of transforming the traditional four kinds of violation of the obligation of loyalty of husband and wife into law. At the same time, the new behavior of violating the obligation of loyalty of husband and wife is brought into the scope of legal adjustment. The second chapter will introduce the definition of the faithful duty of husband and wife, the definition and content of spouse right, and the necessity of writing spouse right into law. The third chapter will discuss the legal provisions about the faithful duty of husband and wife, and their punishment for violating the obligation of faithful husband and wife, which is beneficial to the construction of the legal system of our country. In the fourth chapter, the author will analyze some viewpoints against putting the faithful obligation of husband and wife into the law. At the same time, the author will also analyze the individual problems in reality, and prove that it is feasible and necessary to bring them into the law. The fifth chapter will put forward the specific legal construction of the five kinds of violation of the obligation of loyalty of husband and wife one by one.
