无效婚姻赔偿与补偿制度的构建

【摘要】：生活在世上的每个人都不能脱离婚姻家庭而独立存在，可以这么说，婚姻家庭是组成整个社会的细胞，因此凡涉及到婚姻家庭方面的内容，自然而然会引起社会的广泛关注。目前，关于无效婚姻的一些问题引起各方的关注，焦点就在于在一些案件中当婚姻被宣告无效后，善意一方得不到赔偿与补偿，而恶意一方好像也没受到多大的惩罚，这让好多人觉得很难理解。事实上，我国在1950年与1980年的两部婚姻法中都没有涉及到无效婚姻，直到2001年新修订的《婚姻法》中才增设了无效婚姻制度，填补了在这方面的空白，可以说是立法上重大发展，对于婚姻法的立法价值来说，也是具有历史性的突破。但是，我们也看到了随着社会的变迁，新事物层出不穷。同样地，一些无效婚姻案件出现了新的情况，是现有的法条无法规制的，特别是当婚姻被宣告无效后，无过错方的利益目前还无法从法律中得到支持，因为当时立法者并没有对此进行相关立法的规定，这不能不说是种遗憾。笔者在查阅相关资料并独立思考后，认为有必要构建我国无效婚姻赔偿与补偿制度，这对于以后发生类似的案件能够在法院判决时，做到有法可依，也能让民众满意。本文引言从引发争议的两个案件出发，思考现有无效婚姻制度在赔偿与补偿方面的规定不完善;第一部分首先介绍了无效婚姻赔偿与补偿制度的一些相关的基本理论;第二部分论及我国关于无效婚姻法律后果的规定，并指出现行《婚姻法》对无效婚姻赔偿与补偿方面规定的缺失;第三部分与第四部分论及构建无效婚姻赔偿与补偿制度的必要性与法理依据;第五部分是介绍国外一些立法技术相对高超的国家对此制度的相关规定以及港澳台的相关规定，包括意大利、法国、德国对这方面的规定，以此做为我们立法的参考;第六部分再结合中国的实际情况，提出在我国构建无效婚姻赔偿与补偿制度的具体思路，，分为赔偿与补偿两个部分，并从金额、范围及程序性方面提出一些个人的见解，希望能够对将来在这方面的立法有所帮助。
[Abstract]:Everyone living in the world can not exist independently from marriage and family. In other words, marriage and family are the cells that make up the whole society. At present, some issues concerning the nullity of the marriage have attracted the attention of all parties. The focus is that in some cases when the marriage is declared null and void, the bona fide party does not receive compensation and compensation, and the malicious party does not seem to have received much punishment. This is difficult for many people to understand. In fact, China did not deal with invalid marriage in the two marriage laws of 1950 and 1980, until the newly revised Marriage Law of 2001 added the invalid marriage system, which filled the gap in this respect. It can be said that it is a great development in legislation, and it is also a historic breakthrough for the legislative value of marriage law. However, we also see that with the changes of society, new things emerge in endlessly. Similarly, some cases of invalid marriages have emerged new situations that cannot be regulated by existing laws, especially when the marriage is declared null and void, and the interests of the no-fault party are not currently supported by the law. Because at that time the legislator did not carry on the related legislation stipulation, this cannot but say a kind of regret. After consulting relevant information and thinking independently, the author thinks that it is necessary to construct the compensation and compensation system of invalid marriage in our country, which can make the people satisfied with the law when similar cases happen in the future. In the first part, the author introduces some basic theories of the annulment marriage compensation and compensation system. The second part deals with the legal consequences of invalid marriage in China, and points out the lack of compensation and compensation for invalid marriage in the current Marriage Law. The third part and the fourth part discuss the necessity and the legal basis of constructing the invalid marriage compensation and compensation system. The fifth part is to introduce the relevant provisions of this system and the relevant provisions of Hong Kong, Macao and Taiwan in some foreign countries with relatively high legislative skills. Including the provisions of Italy, France and Germany in this respect, as a reference for our legislation. The sixth part, in combination with the actual situation in China, puts forward concrete ideas for establishing a system of compensation and compensation for invalid marriages in China. It is divided into two parts: compensation and compensation, and puts forward some personal opinions from the aspects of amount, scope and procedure, hoping to be helpful to the future legislation in this area.
