论我国夫妻财产法律制度的完善

【摘要】：夫妻财产制是婚姻家庭法律体系十分重要的组成部分,事关夫妻财产的归属、管理、使用以及对外财产责任等,特别是在司法实践中,法院审理离婚案件所涉及的财产分割问题,都必须以大妻财产制为裁判依据。因此,从建国后的1950年《婚姻法》,到2001年《婚姻法》修正案,都将夫妻财产制作为立法重点之一,相关条款与内容逐步修订完善。然而受当时社会经济发展水平、人们的婚姻观念以及立法技术所限,无论是法定财产制、约定财产制,还是大妻财产制的其他具体规定,现行法律都还存在一些不如人意之处。在对大妻财产制基础理论进行再梳理、再认知的基础上,文章检讨分析了现行婚姻法夫妻财产制的不足之处,提出了增设非常法定财产制、充实完善约定财产制具体规定以及创制财产差额请求权等立法建议,以更好地发挥夫妻财产制在促进婚姻生活和谐和保护交易安全中的积极作用,进而厘清司法实践中的一些争议和困惑,促进公正司法。
[Abstract]:The marital property system is a very important part of the marriage and family legal system. It relates to the ownership, management, use and external property responsibility of the husband and wife property, especially in the judicial practice. The division of property involved in divorce cases must be judged on the basis of polygamy. Therefore, from the 1950 Marriage Law after the founding of the people's Republic of China to the 2001 Amendment of the Marriage Law, the husband and wife property was made as one of the key points of the legislation, and the relevant clauses and contents were gradually revised and perfected. However, due to the level of social and economic development at that time, people's concept of marriage and legislative techniques, whether it is legal property system, agreed property system, or other specific provisions of the property system of polygamy, there are still some unsatisfactory aspects of the current law. On the basis of reviewing and rerecognizing the basic theory of matrimonial property system, the article reviews and analyzes the deficiencies of the current marital property system in the Marriage Law, and puts forward the establishment of an extraordinary legal property system. To enrich and improve the specific provisions of the agreed property system and the right to claim for the creation of the difference of property, so as to give better play to the positive role of the marital property system in promoting the harmony of marriage and life and protecting the safety of transactions. Then clarify some disputes and puzzles in judicial practice, and promote fair administration of justice.
